I have added it to the updated Exhibit E-2 - Mining <br /> Plan Map. <br /> 4. Page 22 states "periods of inactivity will be, but may last up to 6 months or more." The <br /> Division requires any operation that is inactive for 180 days or more file for intermittent <br /> status. The Operator needs to revise the mining plan and provide a statement indicating the <br /> operation is an intermittent site in accordance with C.R.S. 34-32.5-103(l l)(b). <br /> We understand that if these periods extend past the 6 months (180 days) as I <br /> noted, that TC would have to be filed for at that time. I added text on page 23 to <br /> address this. However, I thought that was what this did, at least that has been my <br /> understanding for about the last 30 years. C.R.S. 34-32.5-103(11)(b) deals with <br /> Temporary Cessation (TC) and what I described were periods of time when the <br /> mine would be operated intermittently. I can't find the word "intermittent" in the <br /> law only in the rules so I am unclear what the difference is. That word was not <br /> used in the text, it said periods of inactivity. <br /> 6.3.4 Exhibit D- Reclamation Plan <br /> 5. Page 18 of Exhibit B provides a statement on what type of fertilizer will be used but does not <br /> state how it will be spread across the affected area. Please clarify how the fertilizer will be <br /> laid down on the affected area and that the statements made in Exhibit B also apply to <br /> Exhibit D. <br />
