RECLAMATION PLAN (coNT) EXHIBIT E <br /> September 2019 <br /> eral compositions there will be no pollutants to be mined, <br /> handled or disposed of within the permit area . <br /> 3 . 1 . 6 Water - General Requirements <br /> (1) This operation is a dry pit operation with no water re- <br /> quirements and no affect on water quantity or quality in the <br /> drainage during and after the mining operation. The following <br /> measures will have no affect on either surface or ground water <br /> systems of the drainage . <br /> (a) This operation will not interfere with any Colorado <br /> water laws or regulations governing existing water rights . <br /> (b) There will be no Federal or Colorado water quality laws <br /> and regulation that affect this operation or water quality <br /> standard and site specific classification and standard <br /> adopted by the Colorado Water Quality Control Commission. <br /> (c) Applicable Federal and Colorado dredge and fill require- <br /> ments will not be affected by this operation. The applicant <br /> has filed a 2002 letter from the Corps of Engineers, with <br /> the Division, stating that no 404 permit will be required. <br /> A request for information was sent to the U. S . Army Corps of <br /> Engineers on February 26, 2020 regarding an extension of <br /> this exemption or the need for a permit continuing on. <br /> (d) There will be no temporary or large siltation structures <br /> in this operation. The holes mined in the sand creek bed are <br /> refilled and replenished with sand after every event that <br /> water flows down the channel . It leaves the holes full of <br /> sand and the channel bed flat and uniform. <br /> (2) There will not be any water impoundments of any type . The <br /> operation will not affect or conflict with any water pollution <br /> laws, rules or regulations of the federal government, the <br /> state of Colorado or with any local government pollution <br /> ordinances . <br /> (3) All surface areas of the affected land that have been <br /> disturbed, including soil piles will be stabilized and pro- <br /> tected so as to control erosion. The soil piles will be <br /> temporarily seeded using the approved mix at a rate of 20 lbs <br /> per acre . <br /> 15 (REVISED 3/6/2020) <br />
