There will be no lakes or ponds constructed. <br /> (8) The operator' s choice of reclamation is open space consis- <br /> tent with the surrounding territory. Back slopes will be <br /> finished on both sides of the Sand Arroyo channel at 3h: lv or <br /> flatter if required due to mining. <br /> (9) The operator will backfill with material generated from <br /> the MLRB permitted area . The plan is currently approved to <br /> include importing Inert Fill Material as described in Rule <br /> 1 . 1 (20) and the affidavit was filed with the 2002 application <br /> packet . <br /> The Notice to the office shall include the following: <br /> (a) This pit lies about 6 miles west southwest of <br /> Walsenburg north of Highway 160 . <br /> (b) The approximate volume of inert material for backfill- <br /> ing and backsloping has not been projected at this time <br /> due to the anticipated long life of the mine . <br /> (c) Signed Affidavit - This was supplied under additional <br /> materials . <br /> (d) The date the pit commenced was in 1950 and is projected <br /> to end by 2100 . <br /> (e) The only backfilling will be on the arroyo banks which <br /> will result in a post-mining configuration, compatible <br /> with the approved post-mining land use and similar to <br /> the present use . <br /> (I) The material will be placed in the backfill by front- <br /> end loader and/or scrapers . This action will stabilize <br /> the material and prevent unacceptable settling and <br /> voids . <br /> (10) If any material is to be disposed of in the affected area <br /> it will be backsloped so as to prevent release of pollutants . <br /> There are no pollutants in the material that qualifies as <br /> Inert Material, that is brought in or originates on site . <br /> (11) No unauthorized release of pollutants to groundwater <br /> shall occur from any materials mined, handled or disposed of <br /> within the permit area .
