After the site has been released by the Board, the <br /> landowners may allow public access if it is deemed beneficial . <br /> Part 46 of MSHA will be followed on this site . <br /> 3 . 1 . 5 Reclamation Measure - Material Handling <br /> (1) Grading will be carried on so as to create a final topog- <br /> raphy appropriate to the final land use . However, any back <br /> sloping along the Sand Arroyo channel perimeters will probably <br /> be eroded away in the first large downpour. On the upland <br /> site south of Sand Arroyo the slope will be graded 3h to lv or <br /> less . <br /> (2) There will be no overburden or waste material to use in <br /> back sloping. There will be no leaching of toxic acid or acid- <br /> forming materials . <br /> (3) All grading will be done in a manner to control erosion <br /> and siltation of the affected lands and to protect the areas <br /> outside the affected land from slides or other damage . The <br /> slopes outside the arroyo will be graded 3h to lv. In the <br /> Technical Revision filed in 2013 , it was determined that <br /> arroyo slopes disturbed by mining would be graded while those <br /> naturally created would remain as nature provided. Any recon- <br /> structed slope later damaged by flooding were not required to <br /> be rebuilt . <br /> (4) Backfilling and grading shall be done as soon as opera- <br /> tionally feasible . However it must be remembered that this has <br /> been and will continue to be a long term operation. Backfill- <br /> ing will be done using a cut/fill method where the material <br /> will be pushed down slope . <br /> (5) There is no refuse, acid forming or toxic materials cre- <br /> ated by mining or used in this operation. The sand arroyo <br /> will remain basically the same way it has been over the years <br /> which will not create unsightliness or affect the drainage <br /> operation. The upland area will be graded as described and <br /> revegetated as rangeland to blend with the surrounding area . <br /> (6) There will be no drill or auger holes to be plugged. <br /> Neither will there be any adits or shafts . <br /> 13 (REVISED 3/6/2020) <br />
