Environment Impact Study (presumed to mean Statement)—Environmental Impact <br /> Statements are required by the National Environmental Policy Act(NEPA)process which is <br /> a requirement that"Federal agencies prepare an EIS is a proposed federal action is <br /> determined to significantly affect the quality of the human environment." <br /> https://www.epa. o�pa/national-environmental-policy-act-review-process#EIS. As this <br /> mining effort is not a federal action, an EIS is inappropriate and not required. <br /> • David and Cheryl Rogers, received November 27, 2019 <br /> 1. Posted sign (Rule 1.6.2(1)(b)—a sign was posted prior to the original DRMS 112 submission <br /> on July 25, 2019 and photo proof was included in the submission file under heading RULE <br /> 1.6.2(1)(B)with a certification date of July 30, 2019. Unfortunately, it has become <br /> increasingly common that posted signs are removed and/or destroyed during the public <br /> comment period of DRMS applications. It appears that sign destruction and/or removal did <br /> occur in this case. <br /> 2. Aquifer Impact— Impact on the aquifer below the Cuerno Verde Subdivision will not occur. <br /> The aquifer is located in the Dakota Sandstone—the target of local wells in the area—which <br /> beneath the Bradford Mesa Quarry is approximately 1400 feet below the ground surface and <br /> outcrops 3,000-4,000 feet east of County Road 120. Blasting will occur to depths no greater <br /> than 100 feet below the pre-mine ground surface which is>1,000 feet above the Dakota <br /> sandstone aquifer. Additional details regarding blasting are included in Appendix 3— <br /> Preliminary Blast Plan of this Preliminary Adequacy Review submittal. <br /> Appendix 3 includes an annotated map from the Colorado Division of Water Resources <br /> detailing well locations near the permit boundary and depth to the Dakota Sandstone aquifer. <br /> Also included in Appendix 3, please find well construction information for the three wells <br /> listed on Figure 2 in the Preliminary Blast Report. This includes the only structure in the <br /> Cuerno Verde Subdivision, as discoverable in Huerfano County Assessor records. <br /> 3. Exhibit H/Wildlife Impact and EIS —See the above comments to Michael Bigpond's <br /> objection numbered I and 6. <br /> 4. Exhibit M—See the above comment to Michael Bigpond's objection numbered 5. <br /> 5. Conditional Use Permit—A full Conditional Use Permit is in place with the Huerfano <br /> County Planning and County Commissioner office. CUP 00-060 was approved by Huerfano <br /> County Commissioners on September 20, 2000. This CUP runs with the land and is still valid <br /> as it is a vested property right. Any changes to the CUP must be requested by the Huerfano <br /> County Board of County Commissioners as detailed in Huerfano County Zoning Regulation <br /> 1.06.04. Until such action occurs, no changes to the CUP are mandated by Huerfano County <br /> regulations._ <br /> Bradford Mesa— Preliminary Adequacy Response 14 <br />
