Obiections Received <br /> 44. Please address the request made by Michael Bigpond regarding an Environmental <br /> Impact Study for homes located Yz mile east of the proposed quarry in the Cuerno Verde <br /> Subdivision. <br /> As of the November 27, 2019, public comment period for this permit application,two objections <br /> were received by the DBMS. A third objection was received on December 2, 2019, following the <br /> closure of the public comment period. All three objections will be addressed as follows. <br /> • Michael Bigpond, received November 13, 2019 <br /> 1. Exhibit H—the objection details that the CPW letter was missing. The missing letter was <br /> likely the result of viewing an incomplete permit application at the County level. The permit <br /> application on file with the Huerfano County Clerk is now complete and will be replaced <br /> with this Preliminary Adequacy Review submittal. The applicant commits to conducting <br /> wildlife surveys as detailed by the June 3, 2019 CPW review which will be completed prior <br /> to the start of mining. <br /> 2. Bradford Reservoir impact—the active mining area does not include the area known as the <br /> Bradford Reservoir which is currently a dry salt lake bed. Furthermore,the primary canal <br /> which used to feed the Bradford Reservoir is now abandoned as the Highway 25 expansion <br /> that occurred sometime prior to the official 2010 abandonment cut off the ditch <br /> approximately 1.6 miles north of the northern most DBMS permit boundary. <br /> 3. Exhibit J—additional vegetation information is now included in Exhibit J and on Map C-1. It <br /> appears Mr. Bigpond misread the date on the photos—dates previous read 190613 and were <br /> meant to be interpreted as June 13, 2019. <br /> 4. Exhibit K-the source of average temperature data is now included in Exhibit K. Wind <br /> information is also included and was sourced from the Colorado Anemometer Loan Program <br /> Walsenburg Airport North (Potts) location which is 4 miles west-southwest of the permit <br /> boundary. Data was recorded from a 30 meter tall tower from February 1,2006 to December <br /> 7, 2011 on a 10 minute interval. The mean wind speed is 15.028 miles per hour and it can be <br /> presumed that wind speeds will be much lower closer to the ground. Additional wind data is <br /> not necessary as wind behavior and impact has not drastically changed through the area; any <br /> additional wind surveys would prove redundant and excessive. The operation has a CDPHE <br /> APEN which regulates dust generation in process. This APEN will be finalized within fifteen <br /> days following the start of operations as per CDPHE regulations and procedures. <br /> 5. Exhibit M—objection details that the SPHO letter was missing. The missing letter was likely <br /> the result of viewing an incomplete permit application at the County level. The permit <br /> application on file with the Huerfano County Clerk is now complete and will be replaced <br /> with this Preliminary Adequacy Review submittal. The SHPO letter dated as received by the <br /> Colorado State Land Board on May 17, 2019 does not require a survey be completed. An <br /> additional SPHO request for comment was made by the DRMS on October 3, 2019 and <br /> Bradford Mesa—Preliminary Adequacy Response 13 <br />
