H-2 <br /> Draw, which is depicted on USGS topographic mapping as an intermittent or ephemeral drainage <br /> extending south to north through the central portion of the Permit Area. <br /> Elevations within the Permit Area range from approximately 4,850 ft. above mean sea level (amsl) <br /> along the western edge, dipping some 20- to 30-ft. to about 4,823 within the centrally-located Ennis <br /> Draw feature,and rising to as high as 4,891 within a promontory area near the southern extent of Section <br /> 6 and northern extent of Section 7. Thereafter,the topography gently descends at a rate of about 50 ft. <br /> per mile to the east and southeast, with the elevation of the Permit Area's easternmost boundary <br /> approximating 4,790 ft. amsl in areas proximal to Interstate 76. The average annual precipitation is <br /> 14.67 inches. In general, the Permit Area (and surrounding area) exhibits a relatively homogeneous <br /> landscape,with the exception of the Ennis Draw feature. <br /> Federal Species:A total of eight Federally-listed species were identified as having the potential to occur <br /> within the Permit Area or that have the potential to be affected by the proposed mining activities. These <br /> include: (a)the Least Tern,Mexican Spotted Owl,Piping Plover,and Whooping Crane(all considered <br /> threatened bird species); (b)the Pallid Sturgeon(and endangered fish); and,(c)the Colorado Butterfly <br /> Plant, Ute Ladies' Tresses, and Western Prairie Fringed Orchid (all considered threatened flowering <br /> plants). The desktop review and field assessment concluded that the potential for occurrence within <br /> the Permit Area, for each/any of these species was"not likely". <br /> State Species:A total of four State-listed species were identified as having the potential to occur within <br /> the Permit Area or that have the potential to be affected by the proposed mining activities. These <br /> include: (a)the Burrowing Owl and Mountain Plover(bird species subject to the Migratory Bird Treaty <br /> Act and considered State Threatened Species and State Special Concern Species,respectively;both of <br /> which are considered as having "possible" potential occurrence within the site; and, (b) the Black- <br /> Tailed Prairie Dog(a species of State Special Concern;occurrence potential of"not likely")and Plains <br /> Pocket Gopher(occurrence potential of"likely"),both mammalian species. <br /> The CPW District Wildlife Manager was contacted on January 7, 2019,regarding species of concern <br /> in the project area to obtain additional information. The District Manager stated that CPW generally <br /> requests a 30-day window for reviewing land use proposals, and that he could provide comments once <br /> CPW receives the Use by Special Review(USR)notice from Weld County planning Department.
