H-3 <br /> In summary, preliminary determinations suggest that the presence of Federally-listed threatened, <br /> endangered,proposed, or candidate species within or proximal to the Permit Area is unlikely(subject <br /> to USFWS concurrence). State-listed species identified as having a potential for occurrence are the <br /> Burrowing Owl, Mountain Plover (both considered as "possible"), and the Plains Pocket Gopher <br /> (considered "likely"), respectively. No known occurrences of these species within the Project Area <br /> were identified during the desktop review or the field investigation. Due to the potential for occurrence <br /> of these species,CSC will consult with USFWS and CPW to determine if and to what extent mitigation <br /> measures, if any, may be warranted. At this juncture, it is not anticipated that the Keenesburg No. 2 <br /> Mine project would significantly or adversely impact wildlife or wildlife habitat. <br /> (b) Provide a description of seasonal use of the area. <br /> The Permit Area occupies privately-owned surface owned fee simple by Guttersen Ranches LLC and/or <br /> its assigns. It is,in its entirety, comprised of ranch land that is utilized for grazing purposes on a year- <br /> around basis,but may be subject,in whole or part,to non-utilization and/or exclusion from grazing on <br /> a time to time basis, consistent with ranch management objectives. <br /> Virtually all portions of the Permit Area are also subject to year-around usage by oil and gas producing <br /> entities,pipeline service companies, and other utilities, as required. For the most part,these activities <br /> are more heavily concentrated in Sections 5 and 6; T2S; R63W; however, access and service roads <br /> cross other portions of the Permit Area. <br /> With specific consideration to seasonal use by wildlife,it is again noted that the majority of the project <br /> area consists of moderately to heavily grazed pasture land with a significant amount of sandy bare <br /> ground. During the field investigation several raptors, deer, and jackrabbits were observed within the <br /> project area,as well as evidence of small mammal and rodent burrows. In addition,the Environmental <br /> Resource Report for the Keenesburg Project (RETTEW; April 2019); attached hereto as Appendix 1, <br /> identified several sensitive bird and mammal species that have the potential to occur within the project <br /> area. The following Table H-1: Project Area- Seasonal Use By Wildlife lists these game and non- <br /> game resources along with a brief description of the seasonal use of the project area by each specie. <br /> Keenesburg No. 2 Mine_112 Reclamation Operation—November 22, 2019 <br />
