E-5 <br /> There is no "substitute land" involved with the Keenesburg No. 2 Mine project. Therefore, CSC <br /> does not propose reclamation of substitute land. The "affected area" is wholly-contained within <br /> (and coincident with) the designated Permit Area. All "affected area" or area(s) of disturbance <br /> within the Permit Area are to be reclaimed in a manner consistent with the Reclamation Plan, as <br /> stated. <br /> (3) Rule 3.1.3: Time Limit and Phased Reclamation <br /> CSC acknowledges the obligation to complete all reclamation activities "with all reasonable <br /> diligence", and that"each phase of reclamation shall be completed within five (5) years from the <br /> date the Operator informs the Board or Office that such phase has commenced". <br /> As stated above (re: Item 1 — Rule 3.1.1: Establishing Post-Mining Use), under steady-state <br /> conditions,concurrent reclamation will be carried out(on an annual basis)for the full life-of-mine, <br /> to be followed by a five-year post-reclamation monitoring and maintenance period to ensure that <br /> vegetation and stabilization objectives are achieved. Terminal pit reclamation and site facilities <br /> and infrastructure demolition and removal are proposed to occur at cessation of mining activities; <br /> those areas,as well,will be subject to the five-year post-reclamation monitoring and maintenance <br /> plan. <br /> (4) Rule 3.1.4: Public Use <br /> All lands incorporated into the Permit Area are owned fee-simple by Guttersen Ranches LLC and <br /> as such, are private property. The ranch holdings, in the pre-mining condition, are maintained as <br /> private property with no right of public access, as evidence by the presence of perimeter fencing <br /> and locked/gated entrances. CSC presumes that Guttersen Ranches LLC will continue to restrict <br /> public uses. <br /> (d) Where applicable, plans for topsoil segregation, preservation, and replacement for stabilization, <br /> compaction,and grading of spoil,and for revegetation. The revegetation plan shall contain a list of <br /> the preferred species of grass, legumes,forbs,shrubs or trees to be planted,the method and rates of <br /> seeding and planting,the estimated availability of viable seeds in sufficient quantities of the species <br /> proposed to be used, and the proposed time of seeding and planting. <br /> Keenesburg No. 2 Mine-112 Reclamation Operation—November 22, 2019 <br />
