Thereafter,mining will move to areas east of Section 1 (and the <br /> map-depicted Ennis Draw feature), more specifically to Section 6; T02S; R63W and Section 5; T02S; <br /> R63W, respectively, thereby positioning the operation for a southwesterly advancement into Section 7; <br /> T02S; R63W(and potentially into the Ennis Draw corridor). However, a large portion of Section 7, and <br /> the centrally-located"Ennis Draw Corridor",while fully contained within the prescribed Permit Area, are <br /> both currently considered by CSC to be "Temporary Mining Deferral Zones", with the mine planning <br /> specifics (and ultimate mineability) of each TMDZ remaining subject to further(future) investigation(s), <br /> the interpretation of data gained from such investigation(s), as well as economic and other considerations. <br /> Temporary Minim Deferral Zones(TMDZs) <br /> Section 7 TMDZ: While Section 7 (T2N; R63W) is depicted as being included in the overall mine plan <br /> progression,insufficient exploration data exists at this time to allow meaningful depiction of annual mining <br /> blocks and/or the pit progression,in terms of direction of pit advance and sequence. However,CSC expects <br /> that planned/continued exploration activity in this area(concurrent with ongoing mining in those areas more <br /> fully defined) will provide the requisite data to support detailed mine planning within the section, the <br /> completion of which will allow CSC to incorporate Section 7 into the overall life-of-mine plan. CSC <br /> anticipates doing so via a future Technical Revision to the Permit. <br /> Ennis Draw Corridor TMDZ: In addition to the temporary deferral of mining within the Section 7 resource <br /> area, mine planning efforts also incorporate the temporary deferral of mining within a 600-ft. wide <br /> "corridor" centered on the Ennis Draw feature, i.e., an initial (conservatively-derived from field <br /> observations) 300-ft. "setback"on either side of the map-depicted feature. This deferral of mining is due <br /> to a paucity of localized exploration data, in conjunction with the presence of defined"wetland" features <br /> which are present along a south to north trending corridor, generally coincident with the east edge of <br /> Sections 12 and 1. USGS topographic mapping suggests, and baseline field observations have confirmed, <br /> the presence of wetland features in a narrow band extending along a significant portion of the corridor. <br /> Accordingly,CSC early-on completed baseline wetland surveys and delineation mapping for these features, <br /> and, in addition, has more recently requested (and secured) a U.S. Army Corps of Engineers (USACE) <br /> "jurisdictional determination"(dated August 27,2019 and provided herein as Attachment Gl;Approved <br /> Jurisdictional Determination—Keenesburg Project) that the subject features are "non jurisdictional", <br /> so-determined on the basis that the overall "draw" feature is non-tributary to "waters of the U.S." In <br /> addition,USACE has further determined that"no(federal)permit is required for work at this location". <br /> Keenesburg No. 2 Mine-112 Reclamation Operation—November 22, 2019 <br />
