New maps are provided in Attachment 2. <br /> Item 15—Exhibit D—Mining Plan <br /> Exhibit D has been modified to include additional details of mining operations, earthmoving methods, <br /> excavation practices, and highwall geometry.A modified Exhibit D is included in Attachment 3. <br /> Item 16—Utilities within the Affected Lands <br /> Exhibit C2: Pre-Mining Map has been updated to reflect the location of all known utilities and utility <br /> easements within the proposed permit boundary, including the location of Morgan County Quality Water <br /> District's water line, Morgan County underground power line, Crown Castle Antenna Lease,the Kinder <br /> Morgan box, and the Wiggins Telephone fiber optic line.As discussed above, Black Mountain has contacted <br /> these companies to begin discussions regarding the location of their utilities and the prospect of relocating <br /> those utilities.A 200-foot buffer has been included on the maps around some of these utilities as a <br /> precaution.Additionally,the proposed utility easement corridor for all utilities has been shown on <br /> confidential Exhibit C6.1—Exhibit C6.2. Black Mountain proposes to continue discussions regarding the <br /> relocation of these utilities as site construction activities begin.The water line and powerline are located on <br /> land proposed for mining starting in year 7 and the Wiggins Telephone line runs through land proposed for <br /> mining starting in at the end of year 2. If agreements cannot be obtained prior to the deadline for relocation, <br /> the lines will be mined around, and the 200-foot buffer will remain. New pits will be built and engineered, <br /> and ramps and haul roads will be built in and out of the new pit areas.This may cause an adjustment in the <br /> timing of mining certain areas. New maps are provided in Attachment 2. <br /> Item 17—Groundwater Monitoring Plan <br /> Black Mountain is moving forward with the installation of monitoring wells within the buffer area of the <br /> permit boundary and within the Hay Gulch aquifer to gather baseline groundwater data as well as monitor <br /> water quality and quantity throughout the life of the mine. Black Mountain will provide copies of the <br /> approved permits for these monitoring wells from the Colorado Division of Water Resources to the state <br /> once available.Additionally, Black Mountain will provide quarterly quality and quantity data from these <br /> wells to the division as part of the annual report. <br /> The proposed water quality testing parameters shown on Table E3 of the application were taken directly <br /> from Tables 3 and 4 of the State of Colorado Water Quality Commission's(WQCC) Regulation No.41,The <br /> Basis Standards for Groundwater(5 CCR 1024-41),which pertain to agricultural standards. Black Mountain <br /> feels the agricultural standards more accurately represent the water use in the area, which is mainly <br /> irrigation and livestock watering. Much of the water from the nearby Empire Reservoir is taken out each <br /> year to provide water for irrigation and livestock watering.Table 1,which the division references, is directed <br /> more towards drinking water,which Black Mountain does not believe accurately represents the main water <br /> uses of the area. <br /> Item 18—Seed Mixture <br /> Black Mountain proposes to use the Weld County Sandy Site Mix,which is shown on page E2 of Exhibit E,for <br /> all seeding and reclamation activities onsite, including vegetating topsoil stockpiles to protect from erosion. <br />
