4 <br /> Black Mountain Sand Weld LLC <br /> 500 Main St. Suite 1200, Fort Worth,TX 76102 <br /> (817) 698-9901 <br /> The Weld County proposed pure live seed (PLS)application rate for this mix is 12.0 Ibs pls/acre.Seeding will <br /> follow Weld County's recommendations. As each stockpile is built,the area will be watered routinely to <br /> prevent erosion from the stockpile.The topsoil stockpile will be built with 5:1 (H:V)slopes. BMPs will be <br /> installed around the base to control runoff as needed. Once a topsoil stockpile is built and shaped <br /> accordingly, it will be disced or ripped and seeded either by drilling or broadcast following Weld County's <br /> seeding recommendations. If broadcast, seeding rates will be doubled. Straw crimping will follow.The <br /> topsoil stockpiles will not be irrigated but will continue to be watered routinely to control erosion until each <br /> area has vegetated.This process will be repeated as each topsoil stockpile is built throughout the life of the <br /> mine. <br /> Item 19—Weed Control Plan <br /> Black Mountain submitted a draft weed control plan to Weld County as part of their application for a Use by <br /> Special Review permit.Once the weed control plan has been approved and finalized, a copy will be provided <br /> to the division. <br /> Item 20—Sign Posting Onsite <br /> Black Mountain will comply with the Minerals Rules and Regulations of the Colorado Mined Land <br /> Reclamation Board for the Extraction of Construction Materials and post a sign clearly visible from the <br /> access road that has a minimum size of one hundred and eighty-seven (187)square inches with an <br /> appropriate font size. <br /> Item 21—Reclamation Plan Map <br /> Confidential Exhibit F, Reclamation Plan Map, has been modified to reflect the division's requested scale of <br /> 1" =500'.This has resulted in Exhibit F being broken into 2 maps—Confidential Exhibit F1—Exhibit F2. New <br /> maps are provided in Attachment 5. Black Mountain requests Exhibit F1—Exhibit F2, Reclamation Plan Map, <br /> remain confidential and has marked the maps as such per the allowance in section 1.3(3) of the <br /> Construction Materials Rules. <br /> Item 22—Wildlife Information <br /> Black Mountain's language proposing the potential relocation of certain species comes from the original <br /> burrowing owl survey report completed by Two Dot Consulting, LLC(2Dot) in August 2018.This survey <br /> report was submitted to the division in a supplemental letter dated July 29,2019.Within 2Dot's <br /> recommendations,which begin on Page 5 of the report,they provide a list of actions that could be taken <br /> during burrowing owl nesting season to remove additional potential habitat(i.e. habitat not currently being <br /> used by burrowing owls but that could potentially be used in the future) from an area that may impede <br /> construction and/or operation activities. <br /> Black Mountain will conduct additional burrowing owl surveys on all identified potential burrowing owl <br /> habitat areas prior to conducting any land disturbing activities in those areas.This includes conducting a <br /> survey in 2019 prior to initial site disturbance for facilities construction. If active burrowing owl nests are <br /> found, a 150-foot buffer will be implemented at all active nests between March 15th and October 3111, or <br /> until such time that the owlets fledge, and the nests are abandoned. <br />
