The permittee will need to commit to obtaining proper permitting(such as Weld County Flood Plain <br /> Development, US Army Corps of Engineers, etc.) if required and providing the necessary designs and approval <br /> documentation to DRMS for approval before initiation of any construction activity for this crossing. <br /> (d)the size of area(s)to be worked at any one time. <br /> (e)An approximate timetable to describe the mining operation. The timetable is for the purpose of establishing <br /> the relationship between mining and reclamation during the different phases of a mining operation. You will not <br /> be required to meet specific dates for initiation, or completion of mining in a phase as may be identified in the <br /> timetable. This does not exempt you from complying with the performance standards of Section 3.1. Such <br /> timetable should include: <br /> (i)an estimate of the periods of time which will be required for the various stages or phases of the <br /> operation; <br /> (ii) a description of the size and location of each area to be worked during each phase; and <br /> (iii) outlining the sequence in which each stage or phase of the operation will be carried out. <br /> (Timetables need not be separate and distinct from the mining plan,but may be incorporated therein.) <br /> (f) A map (in Exhibit C - Pre-Mining and Mining Plan Maps(s) of Affected Lands, Subsection 6.4.3) may be used <br /> along with a narrative to present the following information: <br /> (i)nature, depth and thickness of the ore body or deposit to be mined and the thickness and type of <br /> overburden to be removed(may be marked "CONFIDENTIAL," as per Paragraph 1.3(3)); and <br /> (ii) nature of the stratum immediately beneath the material to be mined in sedimentary deposits. <br /> (g) Identify the primary and secondary commodities to be mined/extracted and describe the intended use; and <br /> (h)name and describe the intended use of all expected incidental products to be mined/extracted by the proposed <br /> operation. <br /> The existing conditions map depicts gas lines and/or wells within every mining cell with the exception of Cell 2 <br /> and Cell 4. Please acknowledge that the permittee will be required to obtain the proper authorizations (owner <br /> and COGCC)for abandonment and/or relocation of these features before mining within cells containing gas <br /> lines/wells, and that these features must be abandoned and/or relocated in accordance with all applicable <br /> requirements. <br /> This site is almost entirely within the floodwav of the Big Thompson River, and mining activity will be taking <br /> place within less than 100 feet of the river in several areas. The applicant has not provided a flood impact <br /> analysis to demonstrate how the impacts to the prevailing hydrologic balance will be minimized during a 100 <br /> year flood event. The flood impact analysis should not only address impacts from a post-mining standpoint, but <br /> should address impacts during active miming operations. <br /> The proposed site configuration -within the floodwav,parallel to the existing river, and with open cells on both <br /> sides of the river, has a high likelihood of stream capture daring a flood event. In the past, DRMS has approved <br /> various methods to attempt mitigate the potential impacts from flood events such as: setback restrictions (no <br /> mining within 400'of the riverbank);seasonal restrictions on mining activity near the river, such as prohibiting <br /> slopes steeper than 5:1 within 200'of the river between April I and October 1; or requiring that flood control <br />
