covering of the soil will diminish or impair any of the Conservation Values of the Property or is <br /> otherwise inconsistent with this Deed. <br /> 3.5 Trash. The dumping or uncontained accumulation of any kind of trash or <br /> refuse on the Property, or the storage or any other deposit of abandoned vehicles, is prohibited. <br /> However, waste material generated on the Property as a consequence of a permitted use may be <br /> buried provided the ground over it is restored to its original vegetated condition. <br /> 3.6 Commercial or Industrial Activity. No commercial or industrial uses shall <br /> be allowed on the Property. However,agricultural,ranching, farming or any other use or practice <br /> expressly permitted under Section 4 shall not be considered a commercial or industrial use. In <br /> addition, a home office permitted under applicable zoning or land use regulations shall not be <br /> prohibited provided that the use occurs solely inside a residential building, has no effect on the <br /> Conservation Values and,at most,a negligible impact on the amount and character of traffic on the <br /> Property. As used in this Easement, the term "commercial" shall mean any use or activity that <br /> involves the exchange of cash, goods, services, barter, forgiveness of indebtedness, or any other <br /> remuneration. <br /> 3.7 Feedlot. The establishment or maintenance of any commercial feedlot is <br /> prohibited A commercial feedlot shall be defined for purposes of this Easement as a permanently <br /> constructed,confined area or facility,within which the land is not grazed or cropped annually,for the <br /> purpose of engaging in the business of reception and feeding of livestock, including without <br /> limitation, cattle, pigs, sheep, and poultry. Cattle feeding operations on the Property which are <br /> consistent with normal ranching practices shall not constitute a commercial feedlot. <br /> 3.8 Motor Vehicles. The use of motor vehicles, including automobiles, snow <br /> mobiles,ATVs,four wheelers and motorcycles,which would in any way result in degradation of the <br /> Property and wildlife habitat thereon is prohibited,except such vehicular use by Grantor's owners or <br /> their family or such use as is necessary for ranch or agricultural management purposes, and other <br /> permitted uses and practices stated in Section 4. Such degrading uses shall include, without <br /> limitation,those which increase susceptibility of the soil to erosion or disturb wildlife wintering areas <br /> during winter months. <br /> 3.9 Billboards. The construction,placing or erection of any commercial signs or <br /> billboards on the Property is prohibited,except for signs advertising Grantor's agricultural operations, <br /> signs advising that the Property is under a conservation easement held by Grantee, and signs <br /> advertising that the Property is for sale or lease. <br /> 3.10 Water Pollution. The material degradation or pollution of any surface or sub- <br /> surface water by Grantor or any tenant on the Property is prohibited,above and beyond that which <br /> may occur from normal agricultural practices which are permitted hereunder. <br /> 3.11 Alteration of Water Course and Toaograahv.
