perpetuity the wildlife, ecological, scenic and environmental values and characteristics of the <br /> Property,and to prevent any use of the Property that will impair or interfere with the Conservation <br /> Values of the Property. Grantor intends that this Easement will confine the use of the Property to <br /> such activities as are consistent with the purpose of this Easement. <br /> 2. Affirmative Riahts of Grantee. To accomplish the purpose of this Easement,the <br /> following rights are conveyed to Grantee by this Easement: <br /> (a) To preserve, protect and enhance the Conservation Values of the <br /> Prop <br /> (b) To enter upon the Property at reasonable times upon seventy-two(72) <br /> hours prior written notice by U.S. mail to Grantor in order to monitor Grantor's <br /> compliance with and otherwise enforce the terms of this Easement and to observe, <br /> study and make educational and scientific observations on the Property; provided, <br /> however,that such right of entry shall not unreasonably interfere with Grantor's use <br /> and quiet enjoyment of the Property consistent with this Easement;and <br /> (c) To enjoin or prevent any activity on or use of the Property that is <br /> inconsistent with the purpose of this Easement and to require the restoration of such <br /> areas or features of the Property that may be damaged by any inconsistent activity or <br /> use. <br /> 3. Prohibited Uses. Any activity on or use of the Property inconsistent with the purpose <br /> of this Easement is prohibited. Without limiting the generality of the foregoing, the following <br /> activities and uses are expressly prohibited: <br /> 3.1 New Structures and Improvements. New buildings,improvements,or other <br /> structures may not be built without the advance written permission of Grantee except as is permitted <br /> in Section 4 below. Grantee may witbhold such permission,in its reasonable discretion,if Grantee <br /> determines that the proposed building,structure,or improvement will diminish or impair one or more <br /> of the Conservation Values of the Property. <br /> 3.2 Subdivision. Any division,subdivision or de facto subdivision of title to the <br /> Property,whether by physical or legal process, is prohibited. <br /> 3.3 Mining. The mining or extraction of soil, sand, gravel, rock, or any other <br /> surface mineral substance,peat or other material is prohibited. <br /> 3.4 Road Construction and Paving. Other than the interior roads that exist as of <br /> the date of this Easement and that are indicated on the Baseline Documentation,Grantor shall not <br /> construct any new roads without first obtaining Grantee's written consent. Grantee may withhold its <br /> permission if it reasonably determines that the proposed road will diminish or impair any of the <br /> Conservation Values of the Property. No portion of the Property shall be paved or otherwise covered <br /> with concrete, asphalt, or any other paving material, without the advance written permission of <br /> Grantee.
