Property is part of a wildlife corridor and connects to the Higbee Wildlife Refuges as <br /> well as several other properties subject to conservation easements. <br /> D. Grantor intends to make a charitable gift of Grantor's interest in the Property <br /> conveyed by this Deed to Grantee for the exclusive purpose of assuring that, under Grantee's <br /> perpetual stewardship, (i) the Property will be forever in agricultural and ranching management <br /> activities,(ii)the open space character of the Property will be conserved and maintained forever,and <br /> (iii) uses of the Property that are inconsistent with the above stated conservation purposes will be <br /> prevented or corrected.The parties agree,however,that the current agricultural and ranching uses of <br /> the Property are consistent with the conservation purposes of this Deed <br /> I <br /> jE. The parties acknowledge that specific Conservation Values of the Propertyhave been <br /> documented in an inventory(the"Baseline Documentation")of the natural features of the Property. <br /> A copy of the Baseline Documentation has been signed by both Grantor and Grantee and is kept on <br /> file at the offices of both parties and has been acknowledged by both Grantor and Grantee as set forth <br /> on the attached Exhibit B. The Baseline Documentation consists of reports,maps,photographs,and <br /> other documentation that the parties agree provide, collectively, an accurate representation of the <br /> Property at the time of this grant and which is intended to serve as an objective information baseline <br /> for monitoring compliance with the terms of this grant. <br /> F. The Property has been used by Grantors primarily as agricultural land. Grantor <br /> intends that the Property's natural characteristics and Conservation Values, as cited above, be <br /> preserved by the continuation of such use,or similar use,that will be compatible with the purposes of <br /> the Grant. <br /> G. Grantor further intends,as owner of the Property,to conveyto Grantee the affirmative <br /> right to preserve and protect the Conservation Values of the Property in perpetuity exclusively for <br /> conservation purposes. <br /> H. Grantee is a publicly supported, tax-exempt nonprofit organization,qualified under <br /> Sections 501(c)(3) and 170(h) of the Internal Revenue Code, as amended (the "Code"), whose <br /> primary purpose is the preservation, protection, or enhancement of land in its natural, scenic, <br /> historical,agricultural, forested,and/or open space condition. <br /> I. Grantee agrees by accepting this grant to honor the intentions ofGrantor stated herein <br /> and to preserve and protect in perpetuity the Conservation Values of the Property for the benefit of <br /> this generation and the generations to come. <br /> NOW, THEREFORE, in consideration of the above recitals and the mutual covenants, <br /> terms, conditions, and restrictions contained herein, and pursuant to the laws of the State of <br /> Colorado, and in particular C.R.S. § 38-30.5-101 et seq., Grantor hereby voluntarily grants and <br /> conveys to Grantee a Conservation Easement(hereafter"Easement")in perpetuity over the Property <br /> of the nature and character and to the extent hereinafter set forth. <br /> 1. Purpoge.
