agricultural uses,and(b)as may be allowed pursuant to previously existing rights of third parties,if <br /> any,related to irrigation systems,water-related projects,or water usage,including water restrictions, <br /> on the Property. <br /> 3.12 Hazardous Materials. The storage,dumping or other disposal of toxic and/or <br /> hazardous materials or of non compostable refuse on the Property is prohibited,except for the above <br /> ground storage and use of fuels, fertilizers, treated lumber and legal chemicals as necessary for the <br /> agricultural operations. All materials shall be stored in accordance with all applicable laws and <br /> regulations,and in a manner which prevents spillage,leakage,and dumping,and which prevents soil, <br /> and surface water or groundwater contamination, and in a manner which is consistent with the <br /> preservation of the Conservation Values of the Property. <br /> 3.13 Wind and Solar Enerev Generation. The construction of commercial wind <br /> and solar energy generation facilities are prohibited With Grantee's written consent,wind and solar <br /> energy generation facilities that are primarily for the generation of energy for use in conjunction with <br /> those activities permitted by this Easement may be constructed in locations on the Property that do <br /> not diminish or impair the Conservation Values. <br /> 3.14 Weed Control. The Property shall be managed in accordance with county and <br /> state regulations governing the control of noxious weeds to the extent reasonably possible <br /> 3.15 Commercial Hunting. No Commercial Hunting shall be allowed on the <br /> Property;provided,however,that Grantor's owners shall be permitted to hunt on the Property and to <br /> € conduct and oversee species and habitat management activities on the Property in exchange for profit <br /> to the limited extent expressly set forth under Section 4. For purposes of this Section 3.15, <br /> "Commercial Hunting" shall mean any hunting by third parties of wildlife(including wildlife bred <br /> and/or raised in captivity by Grantor's owners or any third party),including organized and/or guided <br /> hunting, hunting clubs or similar associations, in exchange for cash, goods, services, barter, <br /> forgiveness of indebtedness, or any other remuneration(collectively "Fees")paid to Grantor. <br /> 4. Reserved Riehts. Grantor reserves to itself and to its successors and assigns, all <br /> rights accruing from their ownership of the Property, including the right to engage in or permit or <br /> invite others to engage in all uses of the Property that are not expressly prohibited herein and are not <br /> inconsistent with the purpose of this Easement. Grantor retains the right to control access to the <br /> Property by all persons, except that Grantee and its designated agents shall have the right of ingress <br /> and egress at reasonable times upon giving notice to Grantor seventy-two(72)hours prior to Grantee <br /> entering the Property for the purpose of inspecting the Property to insure compliance with the terms <br /> of this Easement. Grantor and Grantee acknowledge that the present uses of the Property identified <br /> in the Baseline Documentation are permitted uses hereunder. The following uses and practices, <br /> though not an exhaustive recital of consistent uses and practices,are permitted under this Easement, <br /> and these uses and practices are not to be precluded or prevented by this Easement. Grantor retains <br /> the following rights: <br /> 4.1 Aericultural Operations. To conduct agricultural operations on the <br /> Property, including cultivation of crops consistent with traditional agricultural practices, and <br /> pasturing,grazing,and care of livestock consistent with recognized ranching practices;provided that <br /> 509921 <br /> (00254619/3} ago: 5 of ?z:esa Page 5 <br /> Provers County.
