<br /> <br /> 2 <br />Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve permit renewal <br />application RN-1 for the Fruita Loadout (Loadout). A condition of approval, Stipulation ST-01, <br />that was added to the original permit has not yet been terminated. Stipulation ST-01 is therefore <br />being carried over from the original permit onto the RN-1 permit. No new conditions of approval <br />are being added to the Loadout permit in conjunction with the Division’s proposed approval of <br />RN-1. <br /> <br />This decision is based on a finding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for a formal <br />hearing is made within thirty (30) days following the first publication of the notice of this proposed <br />decision, then this decision becomes final. The permit renewal application, all supporting <br />documentation, and any stipulations or conditions will become a binding part of the permit. <br /> <br />No coal mining operations may be conducted on any Federal surface or coal until the Secretary of <br />the Interior has prepared and approved an associated federal mining plan. There are no federal <br />surface lands, nor is there any federal coal, within the permit boundary of the Loadout. There are <br />no plans to mine coal from within the permit boundary of the Loadout. Secretarial approval of a <br />federal mine plan for the Loadout is therefore not needed. <br /> <br />
