<br /> <br /> 3 <br /> Summary <br /> <br />The Review Process <br /> <br />Permit Renewal Application RN-1 was submitted to the Division on July 28, 2016. The <br />application was submitted by Stover on behalf of CAM. The application was deemed Complete <br />by the Division on August 5, 2016. Letters regarding the Completeness determination were sent <br />by the Division on August 10, 2016 to CAM, Mesa County Commissioners, Mesa County <br />Planning Department, Colorado Parks and Wildlife, the US Fish and Wildlife Service, and History <br />Colorado. The Division received no comments from these entities related to these letters. <br /> <br />CAM notified the public that its RN1 application had been found Complete by publishing a Public <br />Notice in the Daily Sentinel (Grand Junction) once a week for four successive weeks, beginning <br />August 16, 2016. The public comment period associated with the Public Notice ended October 6, <br />2016. The Division received no public comment, nor a request for an informal conference, during <br />the comment period. <br /> <br />The Division sent an adequacy review letter to Stover on September 5, 2018. Responses were <br />submitted to the Division by Stover on October 11, 2018. All adequacy issues were resolved. <br /> <br />The Division updated the site-wide reclamation cost estimate for the Loadout on August 13, 2018. <br />The new, proposed site-wide reclamation liability amount is $1,657,040.95. This is an increase <br />of $32,114.95 above the currently-approved liability amount of $1,624,926.00. CAM has been <br />approved to utilize a cumulative bond schedule (Technical Revision TR-3). The Division <br />presently holds a corporate surety bond instrument in the amount of $10,000. Therefore, upon <br />this Proposed Decision becoming Final, CAM will not need to post any additional bond prior to <br />issuance of the RN-1 permit. <br /> <br />The Division conducted a check of the US Office of Surface Mining’s (OSM) Applicant/Violator <br />System (AVS) on September 10, 2018 regarding CAM. A minor civil penalty matter was noted <br />by OSM at that time. The Division conducted a second AVS check of CAM on November 16, <br />2018. No violations were noted. <br /> <br />Mid-term Review MT1 of the permit application package for the Loadout was conducted on <br />August 28, 2014. Since that Mid-term Review, 7 revisions to the permit have been submitted to, <br />and approved by, the Division. These revisions consist of 1 Technical Revision and 6 Minor <br />Revisions. There is also 1 outstanding stipulation to the permit. The following is a short <br />description of each. <br /> <br />Minor Revisions <br /> <br />MR-1 – Made updates to the permit that were identified in the Midterm 1 (MT-1) review. MR-1 <br />was approved on October 21, 2014. <br /> <br />MR-2 – Updated the Identification of interests information. MR-2 was approved on February 2, <br />2015. <br />
