<br /> <br /> 1 <br /> Introduction <br /> <br />This document is the decision package prepared by the Colorado Division of Reclamation, Mining <br />and Safety (Division) for permit renewal application RN-1 for the Fruita Loadout (DRMS Permit <br />No. C-2010-088). This document includes: 1) the proposed decision to approve the renewal <br />application; 2) a summary which includes a history of the review of the renewal application, a <br />description of the environment affected by the operation, and a description of the mining <br />Loadout’s operation and reclamation plans; and 3) the written findings of compliance the Division <br />has made as required by the Colorado Surface Coal Mining Reclamation Act. Detailed <br />information concerning the findings of compliance can be found in the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. <br /> <br />The Division has received an application for a renewal to a permit to conduct coal loadout and <br />reclamation operations at the Fruita Loadout (Loadout). The application was submitted by J. E. <br />Stover & Associates, Inc. (Stover) on behalf of CAM-Colorado, LLC (CAM). The Loadout will <br />be operated by CAM. The Loadout is located on private lands within Mesa County, Colorado. <br />The legal description of the lands included within the permit area is: <br /> <br />Township 1 North, Range 3 West, Ute P.M. <br />Section 2: Portions of the SW/4, W/2SW/4SE/4 <br />Section 3: Portions of the SE/4, SE/4SE/4NE/4 <br />Section 10: Portions of the N/2NE/4 <br />Section 11: Portions of the N/2NW/4, N/2NE/4, SE/4NE/4 <br /> <br />The Loadout permit boundary contains 208.6 acres of land that is all privately owned. The <br />minerals within the proposed permit area are owned by the respective private surface owners. <br />CAM is approved to disturb 38.1 acres within the permit area. As of this RN-1 findings document, <br />no disturbance related to the development of the Loadout, other than the erection of mine <br />identification signs and permit boundary markers, has taken place. The site is presently in <br />Temporary Cessation status, and has been since July 5, 2012, the date the Division received a <br />letter dated July 2, 2012 from Stover regarding the site’s status. <br />
