(8) If the Operator's choice of reclamation is for agriculture or horticultural crops <br /> which normally require the use of farm equipment, the Operator shall grade so that the <br /> area can be traversed with farm machinery. <br /> This provision is not applicable since the post mining land use is wildlife habitat. <br /> (9) An Operator may backfill structural fill material generated within the MLRB <br /> permitted area into an excavated pit within the permit area as provided for in the MLRB <br /> Permit. <br /> No structural fill will be imported. <br /> (10) All mined material to be disposed of within the affected area must be handled in <br /> such a manner so as to prevent any unauthorized release of pollutants to the surface <br /> drainage system. <br /> No material will be mined on the property. The waste dump will be removed for milling at <br /> an off-site facility. Our Stormwater Management Plan will be in place to prevent <br /> unauthorized release of pollutants. <br /> (11) No unauthorized release of pollutants to groundwater shall occur from any <br /> materials mined, handled or disposed of within the permit area. <br /> No ore will be mined on the property. No disposal of milling waste will occur on the <br /> property. The waste dump material will be removed to a permitted off-site mill for <br /> processing. No milling waste will be returned to the site. As stated above, the Stormwater <br /> Management Plan will be implemented to control site runoff. <br /> 3.1.6 Water—General Requirements <br /> (1) Hydrology and Water Quality: Disturbances to the prevailing hydrologic balance <br /> of the affected land and of the surrounding area and to the quantity or quality of water in <br /> surface and groundwater systems both during and after the mining operation and during <br /> reclamation shall be minimized by measures, including, but not limited to: <br /> (a) compliance with applicable Colorado water laws and regulations governing <br /> injury to existing water rights; <br /> No water rights for the OTRP will be impacted since all potable and operational water <br /> will be purchased and hauled to the site. <br /> (b) compliance with applicable federal and Colorado water quality laws and <br /> regulations, including statewide water quality standards and site-specific <br /> classifications and standards adopted by the Water Quality Control Commission; <br /> 45 <br />
