§2.04 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING ACTIVITIES -- MINIMUM REQUIREMENTS FOR INFORMATION ON ENVIRONMENTAL RESOURCES. 20. Pitkin Waste Ditch 21. McKee Spring 22. Pavys Spring The Pavka Spring No. 1, water right number 9, is located north of SH 133 as shown on Map 9. Since it is located above the loadout it is unlikely the operation will affect the spring. The Calnon W/W Ditch, water right number 3, is owned by a property owner north of SH-133. Since it is located above the loadout it is unlikely the operation will affect the waste water ditch. The remaining water rights are considered to be a suitable distance from the disturbed area not to be affected by surface activities. The surtace drainage system in the surface facilities area will not be interrupted. The mining operation could impact the surtace drainage system by increasing the sediment load in the streams. This impact should not occur because run-off from disturbed areas will be passed through sediment ponds or some other form of alternative sediment control. This sediment control system will protect downstream users such as the Feldman Ditch, Farmers Ditch and Paonia High School. Industrial use of water in the permit and adjacent area is by the Operator. li TR-20 Wildlife use of water in the permit and adjacent areas is for subsistence. Wildlife use the perennial streams, springs and ponds. The operator does not anticipate affecting the flow in any perennial streams, springs or ponds. The United States Fish and Wildlife Service (USFWS) considers any consumptive use of water by the mine to deplete the flow in the Colorado River. Water depletions in the Upper Colorado River Basin have been recognized as a major source of impact to endangered fish species (USFWS 2/93). The Operator will agree to implement the 3/01 2.04 - 14
