§2.04 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING <br />ACTIVITIES -- MINIMUM REQUIREMENTS FOR INFORMATION ON <br />ENVIRONMENTAL RESOURCES. <br />20. Pitkin Waste Ditch <br />21. McKee Spring <br />22. Pavys Spring <br />The Pavka Spring No. 1, water right number 9, is located north of SH <br />133 as shown on Map 9. Since it is located above the loadout it is <br />unlikely the operation will affect the spring. The Calnon W/W Ditch, <br />water right number 3, is owned by a property owner north of SH-133. <br />Since it is located above the loadout it is unlikely the operation will <br />affect the waste water ditch. <br />The remaining water rights are considered to be a suitable distance <br />from the disturbed area not to be affected by surface activities. <br />The surtace drainage system in the surface facilities area will not be <br />interrupted. The mining operation could impact the surtace drainage <br />system by increasing the sediment load in the streams. This impact <br />should not occur because run-off from disturbed areas will be passed <br />through sediment ponds or some other form of alternative sediment <br />control. This sediment control system will protect downstream users <br />such as the Feldman Ditch, Farmers Ditch and Paonia High School. <br />Industrial use of water in the permit and adjacent area is by the <br />Operator. <br />li <br />TR-20 <br />Wildlife use of water in the permit and adjacent areas is for <br />subsistence. Wildlife use the perennial streams, springs and ponds. <br />The operator does not anticipate affecting the flow in any perennial <br />streams, springs or ponds. <br />The United States Fish and Wildlife Service (USFWS) considers any <br />consumptive use of water by the mine to deplete the flow in the <br />Colorado River. Water depletions in the Upper Colorado River Basin <br />have been recognized as a major source of impact to endangered fish <br />species (USFWS 2/93).
