Area 3 Agricultural stockpile Area and Recycling Plant and Yard are uses that <br /> may continue subsequent to OMLR release of these areas from the permit and <br /> are suitable for release. <br /> 3. Area 1 Supporting Scalehouse Area and Yard are uses that may continue <br /> subsequent to OMLR release of these areas from the permit and are suitable for <br /> release. <br /> 4. This leaves only the vegetation surrounding the existing reservoirs - and <br /> planned revegetation of the buffer area for Area 3 for continued supervision <br /> under the exiting warranty and permit, unless released by the OMLR. <br /> To this end, Varra Companies submitted a Technical Revision as a foundation to <br /> establish clarity for the purposes of this Request. The consideration as to what Areas <br /> of the permitted lands may be released from the permit and affirming any continuing <br /> obligations, if any, should provide greater focus for any remaining lands requiring <br /> further attention. The effort will better affirm the suitability of all planned and <br /> continuing uses over post release lands and activities with respect to their identifiable <br /> areas and purposes. These considerations are detailed in the pending Technical <br /> Revision (iterated in part, in blue ink, below - and as supplemented by notes in black): <br /> Kim Ogle and Diana Aungst, Weld County Department of Planning <br /> Services, verified that the planned post mine activities for the Agricultural <br /> Stockpile location and continued recycling activities and uses do not <br /> require further permitting with Weld County. Further, on 31 May 2018, <br /> Diana Aungst, Weld County Planner and Floodplain Manager; indicated that <br /> no FHDP or other floodplain permitting are needed: <br /> The revised Dakolios Map as approved by the OMLR by Technical <br /> Revision in alters the location of the planned vegetative buffer strips <br /> (necessary to better protect the reclaimed return irrigation waters ditch <br /> traversing Area 3). This reduces the total area of the planned grassed <br /> buffer in Area 3 to 4.0± acres. <br /> • The two reservoirs shown (Areas 2 and 4) are completed and shorelines <br /> re-soiled and vegetated. Water levels at both reservoirs are below the <br /> static water level when the reservoirs are full. Vegetation has invaded or <br /> spread and hydrophytic vegetation increases the closer it approaches <br /> current water levels. This vegetation would suffocate and repeat the <br /> succession process as the reservoirs fill and empty over time. The <br /> estimated area of vegetation reported in the 2011 Amendment is the best <br /> estimate of the vegetation that would remain beyond and above the static <br /> water level of the reservoirs, and formed in 2011 part of the basis of <br /> approval met at that time.
