Road Association Agreement <br /> For the Pennsylvania Mountain Road Association <br /> 9. Mailing Address.Notices and correspondence involving the use of Forest Service Road 698 <br /> shall initially be directed to: 628 McSkimminx Road,Aspen, Colorado 81611. <br /> io. Road Association Agent.The initial agent of the Road Association shall be Mark Mayer who <br /> shall be the contact person and liaison between the Road Association and the United States Forest <br /> Service. <br /> ii. Term. The term of the Road Association shall be perpetual, unless dissolved by the <br /> Members or by operation of law. <br /> ARTICLE THREE - BUSINESS OF THE ROAD ASSOCIATION <br /> 12. The only business of the Road Association shall be to act as the unified spokesperson for <br /> the owners of lands which use Forest Service Road 698. Additionally,the Road Association may <br /> make and enforce rules regarding the use of Forest Service Road 698, if required by the United <br /> States Forest Service. <br /> 13. The Forest Service will provide authorization to the Association for the road use,with terms <br /> and conditions for maintenance of the road.The Association will be required to maintain the road <br /> to Forest Service standards,and will onlybe allowed use to what permitted in the authorization.(no <br /> new "rules" can be made in regards to road use, without authorization through a permit or <br /> amendment of the permit by the Forest Service.) <br /> 14. The RoadAssociation intends to allow the Forest Service access to the permitted road,once <br /> finalize(:. The Forest Service use will only be for administrative purposes, not for public use. <br /> ARTICLE FOUR - MANAGEMENT OF THE ROAD ASSOCIATION <br /> 15. Management ofthe Road Association. The landowners shall manage the Road Association. <br /> rnecordingiy, the load Association Agent, shall: (i) manage the affairs and basiness of the Road <br /> Association; GO exercise the authority and powers granted to the Road Association; (iii)delegate <br /> their authority to appropriate third-parties;and(iv)otherwise act in all other matters onbehalf of <br /> and in the best interests of the Road Association. All matters except for day-to-day administration <br /> must be agreed to by the majority of the landowners. <br /> 16. Execution of Documents. Any document or instrument of any and every nature,which is <br /> intended to bind the Road Association,shall be valid and binding for all purposes if executed by the <br /> Road Association Agent. <br /> Page 2 of 8 <br />
