1 " `z <br /> PENNSYLVANIA MOUNTAIN ROAD ASSOCIATION AGREEMENT <br /> THIS AGREEMENT is made and entered into by and among the owners of lands served by Forest <br /> Service Road 698 on Pennsylvania Mountain. <br /> ARTICLE ONE - DEFINITIONS <br /> The following terms used in this Road Association Agreement shall have the following meanings: <br /> 1. Agreement. Agreement shall mean th is Road Association Agreement as originally executed <br /> and as amended from time to time. <br /> 2. Forest Service Road 698. Forest System Road 698 is located on Pike National Forest,Park <br /> County,Colorado. The road is open to full-size motor vehicles to the public for 1.25 miles,it crosses <br /> private and Forest System lands and terminates at private property. The road continues to travel <br /> through private land,and back onto Forest System lands,not as a designated Forest System road. <br /> 3. Landowners. The persons owning the real property described on Exhibit A shall be the <br /> initial members of the Road Association and are called "Landowners" in this Agreement. <br /> Membership in the Road Association shall "run with the land" and may never be severed or <br /> separated from the real property using Forest Service Road 698. <br /> 4. National Forest Service,Department ofAgriculture. The NFS-USDA"Forest Service"owns <br /> the surface rights and is authorized by Congress in 36 CFR 251,to issue Special Use Permits for <br /> lard uses. The permit is administered out of the South Park Ranger District,Pike and San Isabel <br /> National Forests and Cimarron and Comanche National Grasslands. <br /> ,. :Members. Members shall mean the Persons who executed this Road Association Agreement <br /> as the Landowners owning lands served by or otherwise benefitted by Forest Service Road 698,and <br /> their successors as provided herein. <br /> 6. Person. Person shall mean any individual or entity,and the heirs,executors,administrators, <br /> legal representatives,successors and assigns of such'-Persun,"where the context so permits. <br /> ARTICLE TWO - FORMATION OF THE ROAD ASSOCIATION <br /> 7. Name. The name of the entity is"The Pennsylvania Mountain Road Association." <br /> 8. Purpose. The Forest Service is requiring the Road User's Association to hold a Special Use <br /> Permit for road use on National Forest System lands with the USDA Forest Service,and to provide <br /> one point of contact for permit administration purposes. <br />
