4) Reclamation materials are primarily plant byproduct and the need to store such <br /> material will ensure that all backfilling and grading shall be completed as soon as <br /> feasible. Please see Exhibit D for the estimated timetable for the mining procedure <br /> as determined by on site conditions. <br /> 5) No acid-forming or toxic producing materials will be mined or are expected to be <br /> encountered during the operation. <br /> 6) Drill or auger holes that are part of the mining operation will be plugged with only <br /> non-combustible material, shall be backfilled and graded in a manner consistent with <br /> the post mine land use and shall comply with the provisions of the Act, Construction <br /> Material Rules and Regulations. <br /> 7)The edges of the reclaimed affected land shall match the existing topography and <br /> shall be graded no steeper than 3:1 as shown on the attached reclamation plan. A <br /> small infiltration basin is proposed in a topographic <br /> low, and slopes leading to the interim water will not be steeper than 3:1. <br /> 8) Agricultural or horticultural crops is not the selected choice for reclaimed land use. <br /> 9)There is currently no intention of bringing structural fill from material generated <br /> outside of the permit area. Should that change, the Operator will provide the Office <br /> notice of any proposed backfill activity not identified in the approved Reclamation <br /> Plan. <br /> 10)All necessary BMPs shall be employed to ensure that no unauthorized release of any <br /> pollutants to the surface drainage system. BMP's will be outlined in the associated <br /> SWPPP, SPCC and via good housekeeping practices. <br /> 11)All necessary BMPs shall be employed to ensure that no unauthorized release of any <br /> materials mined, handled or disposed of within the permit area pollutes <br /> groundwater. Mining is not anticipated to encounter groundwater from the <br /> numerous on site borings conducted for the project by the applicant. <br /> 3.1.6) Disturbances to the prevailing hydraulic balance of the surface land and surrounding area <br /> will be minimized through compliance with applicable federal and Colorado water laws <br /> regarding existing water rights and quality standards for surface and ground water and <br /> Colorado dredge and fill requirements.To achieve this, active mining operations will be <br /> confined to as small an area as reasonably possible as shown on the attached mine <br /> plans, and reclamation will be finalized within applicable deadlines as outlined in the <br /> approximate timetable. BMPs will be in place to stabilize affected lands and minimize <br /> and control erosion. <br /> 3.1.7) <br /> 1)The Operator will adhere to all applicable WQCC standards and conditions. The <br /> mining operation is expected to be above the regional water table as determined by on site <br /> borings not showing saturated conditions or groundwater being encountered. As such no <br /> significant impact from mining is expected to groundwater. The operation will be conducted <br /> pursuant to a SPCC, SWPPP and other industry BMP's. Operation is expected to comply with all <br /> applicable requirements of Surface water and groundwater classifications and standards as <br /> required by the CDPHE-WQCC. <br />
