future use to not be contrary to the laws or regulations of this state or the United <br />States, including but not limited to all federal, state and local permits, licenses, <br />and approvals, as applicable to the specific operations." <br />Teton has reviewed the permit documents and finds conflicting information <br />regarding the reclamation plans for the mine access road. At this time, as the <br />Clear Creek County requirements for surfacing such roads remain unclear, Teton <br />commits to reclaiming the roads to a condition suitable for the post mining land <br />use of Forestry. <br />Proposed Technical Revision <br />Teton proposes to reclaim the access road to the Dixie mine area upon cessation <br />of mining activity. This reclamation shall include the establishment of permanent, <br />passive stormwater control features and revegetation with the approved seed <br />mix. Vehicle access shall be prevented by placement of large boulders at the <br />connection to Ute Creek road, behind the existing gate (see Photo 5, below) <br />which shall remain. Berms and water bars shall remain, as necessary to slow <br />stormwater. Revegetation shall be consistent with the reclamation plan approved <br />by the Division on <br />Purpose: Teton has received verbal communication from the Clear Creek <br />County Fire Authority regarding their desire to see a long-term fire break (in the <br />form of the current road grade cleared of significant vegetation). We believe that <br />the proposed reclamation plan would provide for such a fire break. <br />The Clear Creek County Wildfire Protection Plan (www.co.clear- <br />creek.co.us/DocumentCenter/HomeNiew/184) lists the Ute Creek Wildland- <br />Urban Interface area as High Hazard and recommends "Improvfingj defensible <br />space... DevelopfingJ and maintainfing] ...fuelbreaks along all forested sections <br />of primary and secondary neighborhood access routes". The access road at the <br />Dixie mine was utilized during a wildfire in 2015 on the hill to the northwest of the <br />site. <br />The additional area of reclamation is approximately 0.70 acres (as noted by you <br />in your estimation of August 29, 2018), bringing the total reclamation area to <br />1.675 acres within the 4.75 permitted acres. Teton has estimated these areas <br />and presented the permit boundary in the attached map "Exhibit D — Reclamation <br />Plan (Revised)" based on aerial photography and county assessor mapping. <br />Given the timeframe for response, Teton was unable to obtain ground surveys to <br />confirm (and possibly alter) the actual acreage. The permit boundaries have <br />been marked using handheld GPS, to include the approximate boundaries <br />displayed in the attached map.
