63 <br />NECC will not use any pesticides or herbicides without approval from the <br />Division. <br />Prior to seeding and after topsoiling, NECC will conduct a soil -testing plan <br />evaluating the major soil nutrients of nitrogen, potassium, and phosphorus. <br />Results will be forwarded to the Division. Fertilizer application will be based on <br />this testing program. <br />All acid forming and/or toxic materials shall be disposed of in accordance with <br />Section 4.11.4 and Section 4.14.3. <br />Roads approved to support post -mining land use are shown on Maps 15 and 16 <br />Surface Disturbance and Post Mining Land Use East and West Portal <br />respectively. All roads not approved to support post mining land use including <br />light use, access and haul roads will be reclaimed. Reclamation of these roads will <br />proceed when access is no longer needed for maintenance of reclaimed areas. <br />Road base will be removed and placed over refuse. The roads will be ripped to <br />a depth of 18 inches and scarified prior to final seedbed preparation. Fill and cut <br />slopes will be graded to blend with the post -mining topography. Water bars will <br />be installed as necessary to prevent excessive erosion. <br />On August 15, 1985 NECC submitted a rill and gully plan to the Division. This <br />plan was revised in December 1986. Exhibit 29, Rill and Gully Plan, is a copy <br />of this plan. NECC will follow the rill and gully maintenance requirements as <br />outlined in this plan. <br />As previously discussed, revegetation success criteria will be judged according to <br />Sections 4.15.8 and 4.15.10 of the regulations. NECC's post mining land uses will <br />be rangeland and wildlife habitat. Success of the rangeland and wildlife <br />h a b i t a t in the East Portal area will be compared to the Golden Eagle rangeland <br />reference area. The location of the rangeland reference area is shown on Map 10, <br />Vegetation. Map 15, Surface Disturbance and Post mining Land Uses East <br />Portal and Map 16, Surface Disturbance and Post mining Land Uses, West <br />Portal show the location of the specific land uses. Section 4.15.8 will be <br />applicable to these areas. <br />The West Portal area was previously considered a pre -law area which would be <br />required to meet a cover standard only. However, the area has experienced some <br />disturbance from the current mining activities. With the exception of roads <br />shown on Map 16, Surface Disturbance and Post Mining Land Use, the <br />disturbances from current mining activities will be reclaimed to the standards <br />established for the East Portal area. However, since these areas are "pre -law <br />areas", the standard to be met will be based on cover only. Roads will be <br />considered adequately reclaimed when the vegetation cover is equal to or greater <br />than 90 percent of the Golden Eagle rangeland reference area cover, measured at <br />the time of comparison. Shrub clumps will be established throughout the <br />reclaimed area, as previously discussed, to enhance the wildlife habitat. <br />Section 2.05 RN -6 10/17/2016 <br />
