The operation is not expected to intercept the regional ground water table or impact
ground water as discussed above.
(c) Compliance with applicable federal and Colorado dredge and fill
requirements:
This requirement is not applicable since no wetlands will be impacted.
(d) Remove temporary or large siltation structures from drainage ways after
disturbed area are revegetated and stabilized,if required by the Reclamation Plan:
No detention ponds or livestock watering pond will be constructed on the floor of the
operation. Attachment IV shows using New Jersey Barriers to trap runoff sediments. We
propose using a similar structure to control sediments into the adjacent drainageway. The
sediment trap may be easily cleaned as need and the structure may be easily removed
once mining and site reclamation are complete.
(2) Earthen dams, if necessary to impound water, may be constructed if the
formation of such impoundments will not damage adjoining property or conflict with
water pollution laws, rules or regulations of the federal government, the State of
Colorado or with any local government pollution ordinances:
Please see 3.1.6(1)(d)above.
(3) All surface areas of the affected land, including spoil piles shall be stabilized
and protected so as to effectively control erosion:
All surface areas of the affected land will be stabilized and protected so as to effectively
control erosion. The Operator does not plan on having any spoil or overburden piles. If
overburden piles are necessary, they will be of a temporary nature, less than two years, and
will be located on the floor of the Phase where active mining is occurring. The pit floor
will be sloped at a 1.5%grade toward the east which will help prevent erosion and control
runoff, allowing precipitation to infiltrate into the pit floor. All topsoil piles, if not added to
or used within 180 days, will be seeded with the approved topsoil stabilization seed mix.
3.1.7 Ground Water—Specific Requirements:
Ground water is discussed in Exhibit"G".
3.1.8 Wildlife:
(1) All aspects of the mining and reclamation plan shall take into account the
safety and protection of wildlife on the mine site, and all associated facilities with
special attention given to critical periods for wildlife:
31
