DRMS regulations, NHN requested a waiver from Montrose County to disturb within 100 feet of <br />the County right-of-way. Montrose County has granted such a waiver limiting the disturbance to <br />within 25 feet of rights-of-way as a part of the Special Use Permit. <br />General Requirements: NHN will ensure that the construction, maintenance, and postmining <br />conditions of access roads into and across the site of operations will control or prevent erosion <br />and siltation, pollution of air or water, and damage to public or private property. The <br />construction of access roads not within the disturbed area in accordance with 4.05.2(4) will be <br />certified in a report to the Division by a qualified registered professional engineer, except as <br />provided for in Rule 4.03.2(1)(f)(ii). The certification report will be submitted to the Division <br />upon completion of any construction and will indicate that the road has been constructed as <br />designed and in accordance with the approved plan. All access roads will be removed and the <br />land affected reclaimed in accordance with the requirements of 4.03.2(7) unless retention of the <br />road is approved as part of the approved postmining land use and complies with all applicable <br />performance standards and the landowner requests to the Division in writing, that the road or <br />certain parts thereof are to be left open for further use. <br />Design and Construction: Access roads not within the disturbed area in accordance with <br />4.05.2(4) will be designed and constructed in compliance with the following standards in order to <br />control erosion and disturbance of the hydrologic balance. A continuous grade with excessive <br />cuts or embankments will be avoided. Changes of grade will be made to conform as closely as <br />possible to the existing terrain and maximum road grades will be as follows: The overall grade <br />will not be steeper than 10h: Iv (10 percent); The pitch grade will not be steeper than 6.5h: Iv (15 <br />percent) for any consecutive 1,000 feet; The pitch grade exceeding 15 percent will not be longer <br />than 300 feet within any consecutive 1,000 feet. Access roads will have horizontal alignment as <br />consistent with the existing natural topography as possible and will provide the alignment <br />required to meet the performance standards of 4.03.2. Horizontal and vertical alignment will be <br />coordinated to ensure that the road will not cause environmental damage. Road widths will be <br />appropriate for the anticipated volume of traffic and the nature and speed of vehicles to be used. <br />Cut slopes will not be steeper than 1.5h:ly in unconsolidated materials or 0.25h:ly in rock, <br />except that steeper slopes may be specifically authorized by the Division if geotechnical analysis <br />demonstrates that a minimum safety factor of 1.5 can be maintained or if geotechnical analysis <br />demonstrates that a safety factor less than 1.5 will not result in significant environmental harm or <br />harm to the public health and safety. Temporary erosion control measures will be implemented <br />during construction to minimize sedimentation and erosion until permanent control measures can <br />be established. The entire road cut including the surrounding area disturbed by construction will <br />be stabilized with respect to erosion by a vegetation cover or other means approved by the <br />Division immediately after construction is complete. Where a vegetation cover is used, <br />consideration will be given to providing an appropriate growth medium. <br />Section 2.05.3(3) Page 9 March 2018 (TR -16) <br />
