IV. ROLES AND RESPONSIBILITIES <br />A. Joint -Lead Agency Responsibilities: <br />The Joint -Lead Agencies will: <br />1. Retain final responsibility for the content of all NEPA documents, including the <br />Preliminary EA, the Final EA, and the Decision Record for each Agency's respective <br />decision. This responsibility includes determining the purpose of and need for the <br />proposed action and alternatives, selecting a preferred alternative, and determining <br />appropriate mitigation measures. In meeting these responsibilities, the Joint -Lead <br />Agencies will follow all applicable statutory and regulatory requirements. <br />2. To the fullest extent possible consistent with their respective authority and <br />responsibilities, consider the comments, recommendations, data, and analyses <br />provided by the Cooperator during the EA process, with particular consideration <br />given to those topics in which the Cooperator is acknowledged to possess special <br />expertise. <br />3. To the fullest extent practicable and with consideration of the effect such releases <br />may have on the ability of the Joint -Lead Agencies to withhold this information from <br />other parties, provide the Cooperator with documents relevant to the Cooperator's <br />responsibilities as set forth below, including technical reports, data, analyses, <br />comments received, working drafts related to environmental reviews, and the <br />Preliminary and Final EAs. <br />4. Coordinate the exchange of information among the Cooperator, the third -party NEPA <br />Contractor and subcontractors, as applicable. <br />Establish goals and an EA schedule and provide the Cooperator adequate time to <br />review documents, including administrative draft versions of the Preliminary EA and <br />Final EA, technical reports, and cultural reports, as requested. <br />6. Advise in writing and invite to participate in the EA process, any Native American <br />Tribes, state, and local agencies with jurisdiction over any aspect of the Project. <br />7. Inform the Cooperator about the progress of the EA, additional data needs, changes <br />needed in the EA, third -party NEPA contractor Scopes of Work and other aspects of <br />document preparation. <br />GCC Coal Lease EA 3 1 Page <br />CDNR Cooperating Agency Memorandum of Understanding <br />
