IIi <br />B. Cooperating Agency Roles and Responsibilities: <br />As a Cooperating �gency for this EA, CDNR is recognized as having special expertise in the <br />following areas: <br />1. Knowledge of underground coal mining, coal beneficiation, coal mine waste disposal, <br />environmental impacts, subsidence, and reclamation. <br />2. Knowledge of the Colorado Surface Coal Mining Reclamation Act (34-33-101 et <br />seq., C.R.S. 1973 as amended), the Regulations of the Colorado Mined Land <br />Reclamation Board (CMLRB) for Coal Mining (2CR 407-2, 9/14/2005), and the <br />policies and guidelines of the Colorado Division of Reclamation Mining and Safety's <br />Coal Program. <br />To the extent possible and allowable given available resources, CDNR's responsibilities as a <br />Cooperator shall include the following: <br />Assist the Jbint-Lead Agencies in the preparation of the EA, ensuring that interests <br />associated with the Cooperator are considered as part of the EA. Review relevant <br />documents and submit comments to the Joint -Lead Agency Project Managers within <br />agreed-upon time frames. <br />2. Provide the Joint -Lead Agency Project Managers with information to assist in the <br />development of a range of reasonable alternatives and in the analysis of effects on the <br />areas in wNch DNR has special expertise. <br />3. Participate in communications regarding the EA for the Project, including, but not <br />limited to, Conference calls, meetings, and e-mails. When appropriate, send a <br />representative(s) to attend scheduled EA -related meetings or teleconferences <br />scheduled by the Joint -Lead Agencies. <br />4. Provide written comments on EA -related documents within time frames provided by <br />the Joint-L¢ad Agencies. These documents include, but are not limited to, draft <br />versions of 'the Preliminary EA and Final EA, technical reports, and public notices. <br />5. Respond to comments on the Preliminary EA that pertain to Cooperator interests and <br />resource concerns. <br />6. The Cooperator will provide information, comments, and technical expertise to the <br />Joint -Lead Agencies regarding those elements of the EA, and the data and analyses <br />supporting them, for which it has jurisdiction or special expertise or the Joint -Lead <br />Agencies roquests its assistance. In particular, the Cooperator will provide <br />information} on NEPA review assistance and data and information that pertains to the <br />interests of1CDNR including protection of society and the environment from the <br />potential adverse effects of underground coal mining operations, and the reclamation <br />i <br />GCC Coal Lease l A 4 1 Page <br />CDNR Cooperating Agency Memorandum of Understanding <br />
