i <br />II. PURPOSE OF THE MOU <br />The purpose of this MOU is to: <br />1. Designate CDNR as a Cooperating Agency in the development of the EA; <br />2. Provide a framework for cooperation and coordination between the Joint -Lead <br />Agencies and the Cooperator that will ensure successful completion of the EA in a <br />timely, efficient, and thorough manner; <br />3. Recognize the Joint -Lead Agencies as having primary responsibility for the <br />completion of the EA and Decision Record (DR); <br />4. Describe the respective responsibilities and expertise of each of the Parties in the EA <br />process. <br />III. AUTHORITIES FOR THE MOU <br />A. Statutory authorities for the Joint -Lead Agencies to enter into this MOU include, but are <br />not limited to: <br />1. National Environmental Policy Act of 1969 (42 U.S. Code [U.S.C.] 4321 et. seq.) <br />2. Federal Laod Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.) <br />3. Mineral Losing Act of 1920, as amended by the Federal Coal Leasing Amendments <br />Act of 1976 (30 U.S.C. 181 et seq.) and the Energy Policy Act of2005 <br />4. Surface Miping Control and Reclamation Act of 1977 (Public Law 95-87) and 30 <br />CFR Chapter VII — Office of Surface Mining Reclamation and Enforcement, <br />Department of the Interior (30 U.S.C. 1300 — 1309b) <br />5. Council on,Environmental Quality Regulations for Implementing the Procedural <br />Provisions �f NEPA (40 CFR 1500.1-1508.28) <br />6. Department of the Interior Regulations for Implementing NEPA (43 CFR Part 46) <br />B. The authority for the Joint -Lead Agencies and CDNR to participate as a Cooperating <br />Agency is provided by the National Environmental Policy Act, 42 USC 4321 et. Seq. and <br />40 CFR 1501.6- Cooperating Agencies, and 40 CFR 1508.5 Cooperating Agency. <br />As a State of Colorado agency, CDNR has jurisdiction over the management and use of <br />natural resources Within the state.
