Because there is no overburden or topsoil on the old Plant Site area there is <br /> none to save from this area. Map Exhibit F-1- Reclamation Plan Map (Option 2) shows <br /> how the plant site area would be reclaimed if no mining takes place on the pre-law dirt pile <br /> area. Note that the slopes into the lake are left as gravel and will be graded and sloped <br /> only. <br /> In the reclamation plan and in my response to item 15 of your adequacy letter I outline a <br /> second option for the Reclamation Plan which takes into account not mining the pre-law <br /> dirt pile area. In the initial plan, I outlined resoiling the slope around the lake in the old <br /> Plant Site area, but because there is none available now, they will not be resoiled. The <br /> soil or a usable growth medium is only available from the pre-law dirt pile in the northeast <br /> portion and this area will not be redisturbed during mining and reclamation, on the old <br /> Plant Site area. <br /> g. Please indicate on Exhibit C1 —Mining Plan Map any proposed setbacks for the operation, <br /> including from the ditch to the north, and from proposed permit boundaries. <br /> I have added a note to Exhibit C-1 — Mining Plan Maps listing the setbacks as 25 feet <br /> from the permit line as discussed on page 10 paragraph 5. 1 also added 2 lines to the <br /> map showing the top of slope JOS) line and the vertical mining setback line as shown on <br /> the cross section in the upper right-hand corner of the map. The south bank of the Aurora <br /> overflow ditch is a minimum of 80 feet north of the permit line, the Toe of Slope JOS) line <br /> is 25 feet south of the permit line and the vertical digline is 50 feet from the permit <br /> boundary. So at a minimum the distance from the mining limit to the ditch bank will be <br /> 105 feet. <br /> h. For any proposed affected land boundary corners that exist or will exist inside of a pond, please <br /> provide coordinates of latitude and longitude, and describe how the boundary corners will be <br /> delineated in the field. <br /> Only one corner will be located in the pond. Valco, Inc. had to do this during the partial <br /> release of the area south of this line from M-1977-560 to stay in compliance with the <br /> Division of Water Resources regulations governing pre/post lake surface area. The lake <br /> area south of the line was determined to be pre-1981 lake surface and the water area <br /> north of the line is post-1981. Ideally we would have drawn a single line from the east <br /> shore to the west shore and not had a midpoint. A line has been added to Maps Exhibit <br /> C-1 and C-2 that connects the permit corners located on the east and west banks and a <br /> dimension line showing the distance from this line to the corner is included. The <br /> coordinates for the 3 corners that make up this line were also added to the maps. The <br /> only way to physically mark this corner is to place some type of floating marker at that <br /> point. A surface marker is not practical and would be dangerous for the skiers and <br /> boaters using the lake. <br /> The operator has no plans to return to mining that part of the permit area in the future so <br /> therefore it is unlikely that the mine operations will disturb area south of a line drawn from <br /> the permit corner on the east bank where the permit line enters the lake and the permit <br /> corner on the west bank. This line is shown on both Mining Plan Maps (C-1 & C-2) for <br /> reference. Any disturbance south of this line, associated with mining or permit <br /> reclamation could potentially be considered a permit violation. <br />
