the requirement for documentation of surface owner consent for retention of the privately <br />owned segment of the Munger Canyon haul road. During midterm review MT -6 it <br />was determined that the operator had complied with Stipulation No. 32 and it was <br />terminated in August 2010. Stipulation No. 32 has been satisfied by the incorporation <br />of the Easement Agreement effective April 11, 2007 between CAM Mining LLC <br />(Grantee) and #11 Enterprises, Ltd. (Grantor) into Appendix C of the PAP. #11 <br />Enterprises, Ltd., provided a written request for retention of the subject road segment, <br />pursuant to Rule 4.03.1(1)(f)(ii). <br />The following findings apply to the segments of the haul road constructed in <br />1977: <br />1. The applicant has provided a relevant showing statement in lieu of certification, <br />demonstrating that the road meets the performance standards of Rule 4.03.1 <br />(4.03.1(1)(d)(ii)). <br />2. The applicant proposed to modify and retain the road for the post -mining land use, as <br />set forth in permit section 3.3.1. The Division approved the retention of the haul road <br />as the modified road will accommodate the rangeland postmining land use and will <br />comply with all applicable performance standards. The Bureau of Land Management <br />(BLM), surface owner of most of the segment, has requested in writing that the road <br />be retained for the post -mining land use. (4.03.1(1)(f)). The BLM segment of the <br />haul road was reduced to an 8 foot travel width in 2007, in accordance with the <br />approved reclamation plan. Approved final reclamation will entail future removal of <br />culverts and replacement with low water crossings. <br />B. Access Roads <br />In 2007, the upper road segment was fully reclaimed, and the short pre-existing road <br />segment on the valley floor east of the waste disposal site was reduced to an eight foot <br />travel width, in accordance with landowner (BLM) request, to provide access for <br />ranching operations. All culverts along the access road were removed in 2015 (2015 <br />Annual Reclamation Report). Access road specifications are addressed in Permit <br />Section 2.2.2 and Appendix O, page 1 and 2. Width reduction/retention of the short <br />valley bottom segment of the access road immediately to the east of the coal waste <br />disposal site is addressed in Permit Section 3.3.1. <br />Reclamation of the upper segment of the road (reclaimed in 2007) is addressed in <br />Permit Section 3.3.2. This segment of road was constructed in 1977 to allow <br />construction and development of the portal bench area. The segment extends from the <br />Munger Creek valley bottom up the steep canyon side slope to access the coal outcrop. <br />This segment of the road has been fully reclaimed, in accordance with Rule 4.03.2(7). <br />The following specific findings apply to the existing access road constructed in <br />1977: <br />13 <br />
