1. The applicant provided a relevant showing in lieu of certification, demonstrating that <br />the road meets the performance standards of Rule 4.03.2. (4.03.2(1)(f)(ii)) <br />2. The short lower segment of the access road east of the 2004 re -aligned haul road <br />segment, on the Munger Canyon Valley floor, will not be reclaimed in accordance <br />with Rule 4.03.2(7)(a)(i) through (ix), but was modified for use postmining, in <br />accordance with surface landowner (BLM) request. The Division approved the <br />retention of the lower road segment as it will accommodate the postmining land use <br />(rangeland), the modified road will comply with all applicable performance <br />standards, and the landowner (BLM) has made a written request that the road be <br />retained for further use (4.03.2(1)(g)). <br />3. The ford of Munger Canyon, an ephemeral stream with a watershed of at least one <br />square mile, has been approved since it will not seriously alter normal water flow, <br />contribute to sediment load, or cause adverse effects to fish or wildlife. The ford will <br />occur where the permanent access road crosses Munger Creek. The culvert was <br />removed in 2015. (4.03.2(2)(c)). <br />C. Light -Use Roads <br />During November and December 2005, a temporary light use road was constructed along <br />the north fork of Munger Creek, extending from the Munger Canyon Mine access road <br />to the McClane Canyon Mine permit boundary. The purpose of the road was to provide <br />access to an emergency drill site located inside the McClane Canyon Mine permit <br />area (to monitor atmosphere in the McClane mine workings after an explosion). The <br />road was used for only a short time in the winter of 2005/2006, and subsequently <br />reclaimed in the spring of 2006. The road was constructed and reclaimed in accordance <br />with applicable requirements of Rule 4.03.3. See Section 2.2.2.2 of the permit <br />application. <br />On November 14, 2017, the Division approved TR28, which transferred the reclaimed <br />light -use road and emergency drill site from the McClane Canyon Mine permit to the <br />Munger Canyon Mine Permit in addition to the reclamation liability for these <br />reclaimed acres. The drill pad and associated light -use road are accessed through the <br />Munger Canyon Mine permit and were reclaimed in a year prior to Munger Canyon <br />Haul road, waste rock disposal area, and other support areas related to the Munger <br />Canyon Mine. The McClane Canyon Mine remains in temporary cessation, and has <br />not been reclaimed at this time. Due to the similar reclamation time frame, location, <br />logical management unit, and reclamation methods, it was logical and appropriate to <br />transpire these 3.3 reclaimed acres into the Munger Canyon Permit. <br />II. Support Facilities - Rule 4.04 <br />Previously, a coal loadout facility was located approximately 21 miles from the mine <br />site along the D&RGW Railroad siding near Loma, Colorado. Approximately 2.9 acres <br />of disturbance was associated with the facility. The site had previously been used as <br />14 <br />
