The engineering assessment in Exhibit S <br /> demonstrates that the Centurylink phone/data lines will not be damaged by the operation. <br /> 114) In this exhibit, the Applicant shows that a structure agreement form was sent to Colorado <br /> Springs Utilities on October 3, 2017 for their distribution lines along the west side of <br /> Highway 115, to Fort Carson, and on Hitch Rack Ranch property. The certification page is <br /> signed and notarized by the permit Applicant. However, the notary for structure owner was <br /> not signed and notarized. Has the Applicant obtained an executed structure agreement for <br /> these structures? <br /> Response: Transit Mix has not yet received the signed structure agreement. This will be <br /> provided to the Division if it is received. The engineering assessment in Exhibit S <br /> demonstrates that the Colorado Springs Utilities structures will not be damaged by the <br /> operation. <br /> 115) In this exhibit, the Applicant shows that structure agreement forms were sent to the <br /> easement owners for Little Turkey Creek Road on October 3, 2017. The certification pages <br /> are signed and notarized by the permit Applicant. However, the notary for structure owner <br /> pages were not signed and notarized. Has the Applicant obtained any executed structure <br /> agreements for this structure? If so, please be sure to provide these agreements to the <br /> Division. <br /> Response: Transit Mix has not yet received the signed structure agreements from any of <br /> the easement holders. A few of the mailings were returned as "undeliverable", and copies <br /> of the returned envelopes are included in Exhibit S. Transit Mix will provide the Division <br /> copies of any structure agreements whether they are signed or "undeliverable". The <br /> engineering assessment in Exhibit S demonstrates that Little Turkey Creek Road will not <br /> be damaged by the operation. <br /> 116) In Exhibit C, Table C-2 lists 43 easement owners for Little Turkey Creek Road. However, <br /> in this exhibit, the Applicant demonstrates that 30 easement owners were sent structure <br /> agreement forms for this road. Please provide clarification on why the Applicant did not <br /> attempt to obtain structure agreements from 13 of the easement owners identified in Table <br /> C-2. <br /> Response: Table C-2 in Exhibit C has been updated to only include easement owners that <br /> have property west of the quarry area. The 13 easement owners not sent structure <br /> agreements all own property north of the quarry area on a separate spur of Little Turkey <br /> Creek Road, and this spur of Little Turkey Creek Road is not within 200 feet of the <br /> affected lands boundary. There is no requirement or need to obtain a structure agreement <br /> with these 13 easement owners. <br /> 117) In this exhibit, the Applicant lists three distribution lines owned by Colorado Springs <br /> Utilities, one on the west side of Highway 115, one to Fort Carson, and one on the Hitch <br /> Rack Ranch property. However, the Division was unable to locate the distribution line on <br /> Hitch Rack Ranch Quarry(M-2017-049) <br /> Response to Comments—March 9,2018 <br />
