Please confirm the <br /> Applicant has obtained any necessary clearance from the SHPO to conduct the operation. If <br /> clearance from the SHPO has or will be obtained, it should be listed in this exhibit. <br /> Response: Transit Mix previously submitted the cultural resource inventory to SHPO, and <br /> they determined that no further consultation was required. Recent conversations with <br /> SHPO regarding their comment to the Division on the HRR Quarry suggest that SHPO did <br /> not review the previously submitted report in conjunction with Transit Mix's quarry <br /> application. Accordingly, Transit Mix has resubmitted the cultural resource inventory to <br /> SHPO and requested a formal consultation in conjunction with the USACE 404 application <br /> process. Transit Mix has committed not to impact any significant cultural or <br /> archaeological sites in the area. <br /> 111) In this exhibit, the Applicant lists monitoring well permits and a groundwater permit will <br /> be obtained from the Division of Water Resources (DWR). Based on the comment letter <br /> the Division received from DWR on January 4, 2018, a well permit and associated <br /> Substitute Water Supply Plan/Augmentation Plan will not be required for the proposed <br /> operation, for which small amounts of water will be incidentally encountered during the <br /> mining process. Therefore, it appears that a"groundwater permit" will not be required, and <br /> should be removed from this exhibit list. <br /> Response: Exhibit M has been revised to remove "groundwater permit" from the list. <br /> Exhibit M has also been updated to include the monitoring well permit numbers. <br /> EXHIBIT S <br /> 112) In this exhibit, the Applicant shows that a structure agreement form was sent to RMBC <br /> Group LLC on October 30, 2017 for their Schluckebier Headgate and Ditch and Glen Cairn <br /> Reservoir. The certification page is signed and notarized by the permit Applicant. <br /> However, the notary for structure owner was not signed and notarized. Has the Applicant <br /> obtained an executed structure agreement for these structures? If so, please provide this <br /> agreement to the Division. If an agreement cannot be reached, please be sure to provide an <br /> engineering evaluation for these structures, pursuant to Rule 6.4.19(b). <br /> Response: Transit Mix has not yet received the signed structure agreement.
