Please adjust the figure <br /> so that all labeled portions of the plant area are visible. <br /> Response: Figure L-1 has been updated to show all associated structures and facilities <br /> located in the plant area. <br /> EXHIBIT M <br /> 108) In this exhibit, the Applicant states an individual permit will be obtained from the United <br /> States Army Corps of Engineers for disturbances in Little Turkey Creek drainage. Please <br /> clarify the type of disturbances to the creek the operation anticipates. Additionally, please <br /> describe the location(s) where these disturbances will occur. <br /> Response: Consultation with the United States Army Corps of Engineers (USACE) <br /> suggests that Little Turkey Creek and several of its tributaries are Waters of the United <br /> States (WOTUS), and the USACE Individual 404 permit will authorize disturbances in <br /> these WOTUS. Disturbances include the access road crossing of Little Turkey Creek, the <br /> discharge pipe and reclamation channel outlet to Little Turkey Creek, and disturbances to <br /> the channel in the vicinity of fines stockpile F1. <br /> 109) In this exhibit, the Applicant does not list any permits or licenses to be obtained for the use <br /> of Explosives on site. It is the Division's understanding that any person that will use, <br /> possess, control, manufacture, purchase, sell, store, transport, or dispose of any explosives <br /> material in this state must first obtain a valid permit from the Colorado Department of <br /> Labor and Employment, Division of Oil and Public Safety (DOPS). In Exhibit D, the <br /> Applicant proposes using a U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives <br /> licensed third party blasting contractor to conduct all blasting activities on site. According <br /> to the DOPS, if a person holds a federal explosive license or permit, they are still required <br /> to obtain a Colorado Explosives Permit for any explosives work conducted in this state. <br /> Please confirm the blasting contractor and any mine personnel that will possess, control, or <br /> have access to explosives materials on site will be appropriately licensed and/or permitted <br /> with DOPS. Any licenses or permits the Applicant holds or will obtain for the use of <br /> explosives on site should be listed in this exhibit. If the appropriate licenses and/or permits <br /> will be held by the third party blasting contractor, the Applicant is not required to list them <br /> here. However, please confirm this is the case. <br /> Response: Transit Mix is not required to obtain any licenses or permits for blasting, as <br /> these will all be held by the third-party blasting company. Transit Mix commits to using <br /> only a licensed third-party blasting contractor. At this time, Transit Mix intends to use <br /> Buckley Powder, and they already have all the appropriate licenses and certifications. <br /> 110) In this exhibit, the Applicant included a cultural resource inventory of the proposed site <br /> conducted by Cultural Resource Analysts, Inc. (CRA) in 2015. CRA recorded five historic <br /> archaeological sites in the area, all recommended as not eligible for inclusion in the <br /> Hitch Rack Ranch Quarry(M-2017-049) <br /> Response to Comments—March 9,2018 <br />
