Please be sure this line is shown on Figure <br /> C-2, and the owner of the structure is identified. <br /> Response: Figure C-2 has been revised to more clearly present the structures and their <br /> owners. <br /> 118) In this exhibit, the Applicant lists State Highway 115 and a fence along State Highway 115 <br /> owned by the Colorado Board of Land Commissioners (State of Colorado). However, the <br /> Division was unable to locate the fence on Figure C-2. Please be sure the fence is shown on <br /> Figure C-2, and the owner of the structure is identified. <br /> Response: Figure C-2 has been revised to more clearly present the structures and their <br /> owners. <br /> 119) Pursuant to Rule 6.4.19, where the mining operation will adversely affect the stability of <br /> any significant, valuable and permanent man-made structure located within 200 feet of the <br /> affected land, the Applicant may either: <br /> a) Provide a notarized agreement between the Applicant and the person(s) having an <br /> interest in the structure, that the Applicant is to provide compensation for any damage <br /> to the structure; or <br /> b) Where such an agreement cannot be reached, the Applicant shall provide an <br /> appropriate engineering evaluation that demonstrates that such structure shall not be <br /> damaged by activities occurring at the mining operation; or <br /> c) Where such structure is a utility, the Applicant may supply a notarized letter, on <br /> utility letterhead, from the owner(s) of the utility that the mining and reclamation <br /> activities, as proposed, will have <br /> "no negative effect" on their utility. <br /> The Applicant provided engineering evaluations for particular structures, including for the <br /> State Highway 115 and fence owned by State of Colorado (structure agreement reached); <br /> the road, gate, and fence owned by Fort Carson; the overhead electric distribution lines <br /> owned by Colorado Springs Utilities and Black Hills Energy; the buried communications <br /> and data lines owned by Centurylink; and Little Turkey Creek Road owned by RMBC <br /> Group LLC (structure agreement reached) with 43 easement owners that have an interest in <br /> the structure. An engineering evaluation was not provided for the Schluckebier Headgate <br /> and Ditch and Glen Cairn Reservoir owned by RMBC Group LLC for which an executed <br /> structure agreement has not yet been submitted. Please provide either a properly executed <br /> structure agreement or an engineering evaluation for these structures. <br /> Response: Transit Mix will provide an executed structure agreement signed by RMBC <br /> Group LLC. <br /> 120) In all of the engineering evaluations provided, the Introduction section states the location of <br /> the structure(s) is shown on Figure 1. However, the Division could not find a Figure 1 in <br /> this exhibit.
