Donald Skinner has paid the maintenance fees on these <br /> claims every year since 1996. <br /> On August 5, 2005, both Donald Skinner's claims and David Otis' claims were <br /> quitclaimed to Plaintiff Snowmass Mining Co., LLC. (See Exhibit 72) The claims that <br /> were quitclaimed included the claims called Ground Hog, Double Decker, Top Deck, <br /> Bottom Deck, West Deck and East Deck. (See Exhibit 72). The maintenance fees on <br /> all of these claims are current. (See Exhibit 94). <br /> The Southern Claims are depicted in Exhibit 92. <br /> THE PLACER CLAIMS <br /> In October of 2005, the Skinners hired Minex to stake placer claims and also to <br /> do some sampling. Minex staked and located placer claims on the Double Decker, Top <br /> Deck, Bottom Deck, East Deck and Ground Hog claims. Placer claims were also <br /> staked by Minex in October of 2005 at the White Banks claims. <br /> Minex went out to the White Banks Claims again in early October of 2005. Mr. <br /> Schifrin was present on this trip. The purpose of this trip was to put place placer claims <br /> over the lode claims on both the White Banks Claims and the Southern Claims. <br /> Photographs of what work was done are reflected in Exhibits 76 and 77. <br /> When Minex was at the White Banks Claims in October of 2005, they did see Mr. <br /> Congdon's Discovery Notice for one claim. The Notice states that the claims were <br /> discovered on June 25, 2005 and recorded in Pitkin County on August 4, 2005. (See <br /> Exhibit 74). <br /> Minex, on behalf of the Skinners, filed 10 Placer Certificates of Location for the <br /> White Banks Claims with Pitkin County on October 5, 2005. (See Exhibit 80). <br />
