Amended Placer Certificates of Location were filed with Pitkin County on the White <br /> Banks Claims on December 15, 2005. (See Exhibit 82). <br /> In early October of 2005, Minex also perfected the placer claims on the Double <br /> Decker I through VII claims. The Placer Certificates of Location for these claims were <br /> filed with Pitkin County on October 6, 2005 (See Exhibit 81). Amended Placer <br /> Certificates of Location were filed on the Double Decker claims on December 15, 2005. <br /> (See Exhibit 111). <br /> In October of 2005, Minex also collected samples of rocks that were on the <br /> ground on the various claims. They collected alabaster, gypsum and marble samples. <br /> Maintenance fees for the Snowmass Placer 1 through 10 and Double Decker <br /> Placer 1 through 7 claims have been properly paid since 2005. <br /> At no time has Mr. Congdon located placer claims on either the White Banks <br /> claims or the Southern claim locations. <br /> TESTIMONY OF GREG SCHIFRIN <br /> Mr. Schifrin was called as an expert witness by Snowmass Mining. Mr. Schifrin <br /> has a degree in geology from the University of Idaho School of Mines. He is a licensed <br /> geologist. He is a part owner of Minex Exploration that was hired by the Skinners to <br /> perfect their claims. Mr. Schifrin has staked hundreds of thousands of mining claims. <br /> It is Mr. Schifrin's opinion that if the maintenance fees are not paid by September <br /> 1 of each year, then the claims expire and are open for location by someone else. If <br /> you pay the maintenance fee, you do not have to do the labor. <br /> According to Mr. Schifrin, discovery occurs when a mineral is found. For <br /> example, if you pick up a rock and there is gold there, then you have made a discovery. <br /> 12 <br />
