In May of 2007, Mr. Congdon quitclaimed he and his children's interest in the <br /> White Banks Mines to Mystic Eagle Quarry, LLC. (See Exhibit 209). He thought he <br /> might be dying so he did it to protect his children's interests. <br /> THE SOUTHERN LODE CLAIMS <br /> When they were married, Mr. Congdon and Julie Skinner explored the Southern <br /> Claims together. There were some old existing mines on the claims. There was silver <br /> ore in the area. <br /> Mr. Congdon first filed location notices on the Double Decker, Ground Hog and <br /> Gypsum mines in 1985. (See Exhibit 246). In 1987, he refiled certificates to include a <br /> map of each claim. (See Exhibit 246). Mr. Congdon testified that he allowed the <br /> registration to lapse on these three mines in 1992. The Double Decker mine was later <br /> named Maree Love after Mr. Congdon's daughter. In April of 1996, Mr. Congdon filed a <br /> notice of location on the Maree Love mine as attorney in fact for his brother, Tom <br /> Congdon. (See Exhibit 249). <br /> In 1994, Julie Otis Skinner's brother, David Otis, staked and filed location <br /> certificates for the Ground Hog and Double Decker lode claims. (See Exhibit 3). These <br /> claims were in the same locations as historic claims that had been located but then <br /> dropped by Robert Congdon and Julie Otis. <br /> In June of 1996, Donald Skinner located additional lode mining claims which he <br /> named Top Deck, Bottom Deck, East Deck, and West Deck. (See Exhibits 5 and 6). <br /> Donald Skinner testified that he personally posted each of the claims with cairns and <br /> wood laths. Donald Skinner also personally found a discovery on the claims. He found <br /> rock and ore. Donald Skinner filed location certificates for these claims on June 24, <br /> 10 <br />
