Permit Number C-1994-082 Page 5 of 17 <br />The Yoast Mine includes a single remaining substation and approximately 7,355 feet of powerline <br />with poles throughout the property. The substation was constructed to provide electricity to the <br />mining equipment and facilities during the mining process. The substation is privately owned by the <br />Yampa Valley Electric Association (YVEA). Both the powerline and substation were retained as <br />permanent features in support of the post-mining land use as part of TR-37. The YVEA powerline <br />corridor (Phase III) and substation pad (Phase I) are a part of this SL-6 bond release and constitute <br />approximately 8.1 acres and 0.46 acres respectively for a total of 8.56 acres that will not undergo <br />backfilling and grading. <br /> <br />The locations of all permanent features are delineated on Map 2, Phase I and III Bond Release SL-6 <br />Permanent Features Map, in the SL-6 application. <br /> <br />Bond Release Inspection <br /> <br />The Division scheduled and conducted a bond release inspection on July 19, 2017. The site inspection <br />was conducted in accordance with Rule 3.03.2(2). Due to seasonal winter weather conditions, the bond <br />release inspection was not conducted within 30 days of the completed application. Jason Musick <br />represented the Division. The bond release inspection was attended by: Jerry Nettleton and Miranda <br />Blomquist of Seneca Property, LLC, Christine Belka of the Office of Surface Mining and Enforcement <br />(OSMRE), and Jennifer Miaolo of the Bureau of Land Management (BLM). All landowners were <br />notified with only Mr. John Patrick responding. Mr. Patrick noted that his interests would be <br />represented by Mr. Gary Valora as they pertain to the SL-6 bond release and inspection. Gary Valora <br />attended the inspection as a representative for Mr. Patrick. <br /> <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br /> <br />PHASE I <br /> <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when the <br />permittee successfully completes backfilling, regrading, and drainage control in accordance with the <br />approved reclamation plan." SPL’s approved reclamation plan prepared in accordance with Rule 2.05.4 <br />is contained in Volume 9, Tabs 19 through 21 of the permit application package (PAP). Details of the <br />backfilling and grading plan, schedule, and post-mining topography are located in Tabs 19 and 20 of the <br />PAP. Evaluation and inspection were based on the specific requirements of the reclamation plan and the <br />functional requirements of the post-mining land use. Specific reclamation criteria associated with the <br />SL-6 application are as follows: <br /> <br />YPM-13 Drainage – YPM-13 is an approved post-mining drainage channel. Design of the channel, <br />which was to be field fit, called for a trapezoidal channel with either erosion control matting or rock rip <br />rap lining and 3:1 (if rip rap) or 4:1 (if erosion control matting) side slopes. The overall grading of <br />YPM-13 was approved to be 25.8%. <br /> <br />Topsoil Stockpile I – The topsoil in this stockpile was to be redistributed on Haul Road B. Since this <br />area was approved for permanent retention, the topsoil in stockpile I was not needed for reclamation. <br />The topography of the existing topsoil stockpile is consistent with the approved post-mining topography. <br />
