Permit Number C-1994-082 Page 6 of 17 <br />Yampa Valley Electric Association (YVEA) Substation – No reclamation was required for this 0.46 acre <br />disturbance. The YVEA Substation and pad are owned by YVEA and the pad was approved as a <br />permanent feature. <br /> <br />YPM-20 Drainage – YPM-20 is an approved post-mining drainage channel. Design of the channel, <br />which was to be field fit, called for a trapezoidal channel with either erosion control matting or rock rip <br />rap lining and 3:1 ( if rip rap) or 4:1 ( if erosion control matting) side slopes. The overall grade of YPM- <br />20 was approved to be 12.3%. <br /> <br />Pond 012 Watershed – The Pond 012 watershed area includes a portion of the south pit and the neck pit <br />mining areas. These areas were to be graded to approximate original contour, as depicted in the <br />approved Exhibit 20-2 of the PAP, their drainages reestablished, and the areas were to be topsoiled and <br />reseeded. <br /> <br />The Pond 012 watershed area was originally part of the SL-4 bond release request; however, during the <br />adequacy review of the SL-4 bond release application, the Division determined that this area was not <br />eligible for Phase I bond release. In early July 2012, a major rainfall event occurred in the Yoast Mine <br />area, resulting in widespread damage to the south mine post-mining drainage channels. The YPM-5-1, <br />YPM-7, YPM-7A, YPM-6-2, and YPM-6-3 drainages and watersheds, all draining to the Pond 012 <br />watershed, required reconstruction and were excluded from the SL-4 bond release. <br /> <br />The Pond 012 watershed area also included the north inslope of Pond 012, including the Pond 012 slide <br />area. Major landslides have occurred in the Pond 012 slide area on four separate occasions dating back <br />to 2006, and minor slumps and sloughing had been ongoing through 2011. In 2011, SPL completed the <br />regrading and drainage installation portion of the approved slide remediation plan (Technical Revision <br />No. 46). <br /> <br />Pond 013 Slide Area – No reclamation was required for Pond 013, as it has been permitted as a <br />permanent impoundment in its current configuration. Pond 013 was not previously considered for Phase <br />I bond release as it was within the Pond 013 slide area parcel that was required to be observed for at least <br />one year following the 2012 slide activities prior to being eligible for bond release. <br /> <br />Pond 014 – No reclamation was required for this impoundment, as it has been permitted as a permanent <br />impoundment in its current configuration. <br /> <br />Diversion 14 Area - This diversion was to be regraded to approximate original contour, as depicted in <br />the approved Exhibit 20-2 of the PAP and the area was to be topsoiled and reseeded. <br /> <br />PHASE III <br /> <br />Rule 3.03.1(2)(c) states that the final portion of performance bond, "shall be released when the permittee <br />has successfully completed all surface coal mining reclamation operations in accordance with the <br />approved reclamation plan, and the final inspection procedures of 3.03.2 have been satisfied. This shall <br />not be before the expiration of the period specified for revegetation responsibility in 3.02.3." Rule <br />3.03.1(4) states, "No bond shall be fully released until all reclamation requirements of these Rules and <br />the Act are fully met...". The same rule goes on to state, "No acreage shall be released from the permit
