The completeness <br />determination was made in accordance with Section 3.03.2(1)(d). <br /> <br />SPL submitted the bond release application following the procedures described in the Act and <br />Regulations. The application also utilized the Division’s Guideline Regarding Selected Coal Mine Bond <br />Release Issues, dated April 18, 1995. <br /> <br />Public Notice <br /> <br />SPL published notice of the bond release application in Steamboat Pilot once weekly for four <br />consecutive weeks, beginning January 8, 2017. SPL also notified land owners within and adjacent to the <br />mine bond release area, and other interested parties, of the application for bond release, as required by <br />Rule 3.03.2(1). <br /> <br />The Division received no comments, written objections, or requests for an informal conference regarding <br />the bond release application. <br /> <br />Items Approved for Permanent Retention <br /> <br />Roads and associated road culverts approved as permanent features for the Yoast Mine were <br />approved under Technical Revision No’s. 37 and 49 (TR-37 and TR-49) on December 4, 2008 and <br />September 16, 2010 respectively. Access roads include road(s) A and B (road B becomes road LU- <br />3A). Light-use roads include LU-1, LU-2, LU-3A, LU-4, and LU-5. The roads approved for <br />permanent retention were deemed necessary to support the post-mining land use and are utilized by <br />property owners for access. <br /> <br />The Division has approved permanent pond demonstrations for three of the five remaining sediment <br />ponds. Sediment ponds 10, 13, and 14 have received approval from the Division to remain as <br />permanent features and all three receive run-off from the SL-6 bond release areas. The permanent <br />ponds have met the criteria specified under Rule 4.05.9(13) and were deemed necessary to support <br />the post-mining land use. Ponds 13 and 14 are a part of this partial Phase I bond release and <br />constitute .7 acres and .7 acres for both ponds for a total of 1.4 acres which will not undergo <br />backfilling and grading. <br /> <br />Two small livestock/wildlife stock ponds have been approved as permanent structures on the Yoast <br />Mine reclaimed lands. The stock ponds within or immediately adjacent to the SL-6 area include ST-1 <br />and Pond 11A. Stock pond 11A is a part of this partial Phase III bond release and has been approved <br />for phase I and Phase II. Pond 11A constitutes approximately 0.2 acres which has not been backfilled <br />and graded. <br />
