<br /> <br /> <br /> 7 C1981-041 RN7 findings <br /> <br />MR-82: Approved December 21, 2015. This revision incorporated language required by the <br />approval of Bond Release SL-8. <br /> <br />Technical Revisions <br /> <br />TR-70: Approved September 8, 2017. TR-70 approved a reduction in the permit area boundary <br />to remove all property located in Township 10S, Range 98W, Section 27 and 28. All mining <br />related disturbed and affected lands in these sections have achieved final bond release. TR-70 <br />removed all permit area located west of the Colorado River. <br /> <br />TR-69: Approved January 30, 2017. Snowcap Coal Company presented a hydrological <br />communication repair plan, along with a cost estimate for the repair plan and reclamation plan as <br />required by MR-82. This repair plan is in response to suspected hydrologic communication <br />between surface water applied in Tract No. 71 and underground workings. The TR-69 proposed <br />decision was objected to by the landowner, Mr. Rudy Fontanari. The Division met with Mr. <br />Fontanari and his legal representative in Grand Junction on April 7, 2017 for a pre-hearing <br />conference. The pre-hearing conference officer, Mr. Tony Waldron of DRMS, issued a pre- <br />hearing order that condensed the objectors concerns to two issues to be heard at the Mined Land <br />Reclamation Board hearing. The Mined Land Reclamation Board (MLRB) heard the objection <br />at the May 24 and 25, 2017 Board hearing. After hearing the evidence, the MLRB decided to <br />uphold the Division’s proposed decision to approve TR69. On July 5, 2017, the MLRB issued a <br />Board Order for final approval of TR-69. On June 26, 2017, the landowner, Mr. Fontanari filed <br />a Complaint for Judicial Review of the Colorado Mine Land Reclamation Board decision in <br />Mesa County District Court in accordance with Section 24-4-106, C.R.S. (2016) and the <br />Colorado Rules of Civil Procedure. At the time of this renewal, this case is still pending. <br /> <br />TR68: Approved January 21, 2016. TR-68 approved changed the post-mining land use for <br />former pond 8 from fish and wildlife habitat to commercial/industrial. The area is 0.5 acre in <br />size and is adjacent to the agricultural commercial property Kokopelli Farm and Produce. The <br />pre-mining land use of this area was commercial and it will be used to support the commercial <br />agricultural business. <br /> <br />TR-67: Approved February 4, 2016. TR-67 revised the permit area boundary, surface acreage, <br />mineral acreage, affected acreage, removed surface and ground water monitoring points, <br />removed the greasewood reference area, updated the hydrological monitoring plan and updated <br />ownership/control information. These changes were requested as a result of the SL-8 Bond <br />Release. <br /> <br />TR-66: Approved October 9, 2015. TR-66 was submitted to address the adequacy review <br />comments that were raised during the Midterm Permit Review 7 (MT-7). <br />
