Colorado Backhoe Service Page 5 <br /> The Orr Pit- M-2009-074 Adequacy response #1 <br /> January 10, 2018 <br /> 12. The Applicant proposes to reclaim the affected lands to a mixture of commercial, rangeland, and <br /> "farm yard". In accordance with C.R.S. 34-32.5-115(4)(d), please demonstrate the proposed future <br /> use is not contrary to the laws or regulations of Pueblo County. If the applicant is unable to <br /> demonstrate compliance with the county at this time, the Division will require a temporary <br /> reclamation plan to be proposed. This temporary reclamation plan should involve the stabilization of <br /> all affected lands by means of a vegetative cover. After CN-01 is approved and the Applicant can <br /> demonstrate the proposed future use is not in conflict with the county, the Applicant may submit a <br /> Technical Revision to discuss the graveling of the"farm yard". <br /> Prior to obtaining the original permit in 2009 the floor of <br /> the old mine area has been gravel or dirt and under the <br /> reclamation act it only has to be returned to the condition it <br /> was prior to mining. So there is no top spoil/growth medium <br /> available to create a seed bed making it impractical to <br /> temporary seed it . Besides the uses described are allowed in <br /> the cone district that existing on the property now. <br /> The current zoning is Agriculture 2 (A-2) according to <br /> the Pueblo County zoning map. Uses by Right in an A-2 zone <br /> district allows for "farming and ranching" where a yard to <br /> park equipment is a common accepted use . Ranching would <br /> include rangeland which is an acceptable agricultural practice <br /> and other uses that may develop over time would be considered <br /> commercial like a drilling company equipment yard, or a <br /> sawmill . A copy of Title 17 Chapter 17-12 Agriculture one (A-1) and Two (A-2) <br /> Districts Uses By right of the Pueblo County Zoning resolution is <br /> attached for your review. <br /> In June 2013 the Board of County Commissioners (BOCC) <br /> determined that Special Use Permit 228 (aka SUP 1973-015) <br /> issued in 1973 was still valid and grinding of concrete and <br /> asphalt were not violations of that SUP. A copy of the BOCC' s <br /> case Summary showing this is attached. This SPU was <br /> originally issued for gravel mining, processing and operation <br /> of an Asphalt Batch Plant . The operator will refrain from <br /> using the farm yard area for commercial uses not already <br /> allowed for in the zone district and/or in conjunction with <br /> the currently approved Pueblo County Special Use Permit for <br /> mining and associated uses . <br /> EXHIBIT G—Water Information (Rule 6.4.7): <br /> 13.
