Transit Mix received the legal right to enter Hitch Rack Ranch, but has not <br /> received the legal right to use Little Turkey Creek Road for mining operations. <br /> RMBC Group, LLC ("RMBC") owns Hitch Rack Ranch. Id. RMBC has granted <br /> Transit Mix the legal right to enter Hitch Rack Ranch for "mining operations and <br /> the extraction of construction aggregates." Id. The residents of Eagles Nest <br /> subdivision possess a non-exclusive easement on Little Turkey Creek Road. Id. <br /> The Decree that establishes the easement contains rights and restrictions <br /> concerning its use. R. at 0490-91. Transit mix did not receive the legal right to <br /> enter and initiate a mining operation on Little Turkey Creek Road from the owners <br /> of the dominant easement. R. at 4405. <br /> There are serious concerns regarding the potential impact of the proposed <br /> Quarry on the groundwater and hydrologic balance. The water in individual wells <br /> originates from water collected in and conveyed by the fractured granite deposit, <br /> which Transit Mix proposes to destroy and remove permanently. R. at 4406. The <br /> granite deposit that would be removed by the proposed Quarry is both the <br /> collection and delivery system for the small water deposits, which feed the <br /> individual wells. Id. The fractured granite system provides a relatively small <br /> volume of water and is sensitive to being recharged. Id. The proposed Quarry will <br /> permanently remove the granite structure and destroy the water delivery system, <br /> permanently and irrevocably damaging the current water recharge flow system.
