STATEMENT OF FACTS <br /> In March 2016, Transit Mix Concrete Co. filed an application for a 112c <br /> reclamation permit for a site known as Hitch Rack Ranch Quarry ("Quarry"), file <br /> number M-2016-010 ("Application"). R. at 4401. The Application proposed a <br /> construction materials mining operation and on-site processing of mined materials. <br /> R. at 4402. The Quarry would be the fourth quarry in the foothills west of <br /> Colorado Highway 115 near Colorado Springs. Id. <br /> The proposed Quarry boundary includes part of Little Turkey Creek Road, a <br /> private dirt road. R. at 4403. Little Turkey Creek Road is the sole means of access <br /> for residents of the Eagles Nest subdivision. Id. Under the proposed blasting plan <br /> in the Application, Little Turkey Creek Road will be closed during the length of <br /> time needed to successfully complete the blast. R. at 4404. A typical length of <br /> time for a blast is thirty minutes, but Little Turkey Creek Road may be closed for a <br /> longer period of time in the event of a misfire. Id.
